| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter A, Chapter 305, Labor Code, is |
|---|
| 9 | 9 | | amended by adding Section 305.003 to read as follows: |
|---|
| 10 | 10 | | Sec. 305.003. MEMORANDUM OF UNDERSTANDING. The commission |
|---|
| 11 | 11 | | and the coordinating board shall enter into a memorandum of |
|---|
| 12 | 12 | | understanding for the coordination and administration of the grant |
|---|
| 13 | 13 | | program established under Subchapter B. Functions assigned to the |
|---|
| 14 | 14 | | commission under this chapter may be assigned to the coordinating |
|---|
| 15 | 15 | | board pursuant to the memorandum of understanding. |
|---|
| 16 | 16 | | SECTION 2. The transfer to the Texas Higher Education |
|---|
| 17 | 17 | | Coordinating Board of any functions relating to the administration |
|---|
| 18 | 18 | | of the Texas Career Opportunity Grant Program pursuant to a |
|---|
| 19 | 19 | | memorandum of understanding entered into under Section 305.003, |
|---|
| 20 | 20 | | Labor Code, as added by this Act, applies beginning with grants |
|---|
| 21 | 21 | | awarded for the 2010 fall semester. Grants awarded for an academic |
|---|
| 22 | 22 | | period before that semester are covered by the law in effect |
|---|
| 23 | 23 | | immediately before the effective date of this Act, and the former |
|---|
| 24 | 24 | | law is continued in effect for that purpose. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
