| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 39.107(h), Utilities Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (h) The commission shall establish a nonbypassable |
|---|
| 13 | 13 | | surcharge for an electric utility or transmission and distribution |
|---|
| 14 | 14 | | utility to use to recover reasonable and necessary costs incurred |
|---|
| 15 | 15 | | in deploying advanced metering and meter information networks to |
|---|
| 16 | 16 | | residential customers and nonresidential customers other than |
|---|
| 17 | 17 | | those required by the independent system operator to have an |
|---|
| 18 | 18 | | interval data recorder meter. The commission shall ensure that the |
|---|
| 19 | 19 | | nonbypassable surcharge reflects a deployment of advanced meters |
|---|
| 20 | 20 | | that is no more than one-third of the utility's total meters over |
|---|
| 21 | 21 | | each calendar year and shall ensure that the nonbypassable |
|---|
| 22 | 22 | | surcharge does not result in the utility recovering more than its |
|---|
| 23 | 23 | | actual, fully allocated meter and meter information network costs. |
|---|
| 24 | 24 | | The expenses must be allocated to the customer classes receiving |
|---|
| 25 | 25 | | the services, based on the electric utility's most recently |
|---|
| 26 | 26 | | approved tariffs, and the amount of the surcharge must be stated |
|---|
| 27 | 27 | | separately on each customer's bill. The commission by rule shall |
|---|
| 28 | 28 | | provide that a surcharge under this subsection may not be imposed on |
|---|
| 29 | 29 | | a customer before the customer has an advanced meter installed |
|---|
| 30 | 30 | | unless the electric utility or transmission and distribution |
|---|
| 31 | 31 | | utility provides for the customer to recover the full amount of |
|---|
| 32 | 32 | | surcharges paid by means of a discount for billed services after |
|---|
| 33 | 33 | | installation of the meter. |
|---|
| 34 | 34 | | SECTION 2. The Public Utility Commission of Texas shall |
|---|
| 35 | 35 | | adopt rules to implement the changes in law made by Section |
|---|
| 36 | 36 | | 39.107(h), Utilities Code, as amended by this Act. The rules must |
|---|
| 37 | 37 | | take effect not later than January 1, 2010. |

| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2009. |
