| 8 | 8 | | Affairs to determine certain demographic information regarding the |

| 9 | 9 | | occupancy of multiunit residential properties; requiring |
|---|
| 10 | 10 | | applicants for certain tax credits to provide certain demographic |
|---|
| 11 | 11 | | information. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter H, Chapter 2306, Government Code, is |
|---|
| 14 | 14 | | amended by adding Section 2306.189 to read as follows: |
|---|
| 15 | 15 | | Sec. 2306.189. DUTY TO REPORT TO UNITED STATES CENSUS |
|---|
| 16 | 16 | | BUREAU. (a) In this section, "multiunit residential property" has |
|---|
| 17 | 17 | | the meaning assigned by Section 125.001, Civil Practice and |
|---|
| 18 | 18 | | Remedies Code. |
|---|
| 19 | 19 | | (b) The department shall determine the occupancy of |
|---|
| 20 | 20 | | multiunit residential properties in this state and annually forward |
|---|
| 21 | 21 | | that information to the United States Census Bureau. |
|---|
| 22 | 22 | | (c) In determining the occupancy of multiunit residential |
|---|
| 23 | 23 | | properties, the department must collect the following information |
|---|
| 24 | 24 | | for each census tract in this state: |
|---|
| 25 | 25 | | (1) the number of units in each multiunit residential |
|---|
| 26 | 26 | | property; and |
|---|
| 27 | 27 | | (2) the number of occupants in each unit of a multiunit |
|---|
| 28 | 28 | | residential property. |
|---|
| 29 | 29 | | (d) The department may send other statistical information |
|---|
| 30 | 30 | | to the United States Census Bureau if the department determines the |
|---|
| 31 | 31 | | information will assist the bureau in conducting a census. |
|---|
| 32 | 32 | | (e) The owner of a multiunit residential property must |
|---|
| 33 | 33 | | submit to the department the information required by Subsection (c) |
|---|
| 34 | 34 | | and other information requested by the department. |
|---|
| 35 | 35 | | (f) The department shall adopt rules as necessary to |
|---|
| 36 | 36 | | implement this section. |
|---|
| 37 | 37 | | SECTION 2. Subchapter DD, Chapter 2306, Government Code, is |
|---|
| 38 | 38 | | amended by adding Section 2306.6736 to read as follows: |
|---|
| 39 | 39 | | Sec. 2306.6736. REQUIREMENT TO REPORT CERTAIN CENSUS |
|---|
| 40 | 40 | | INFORMATION. The department by rule may require an applicant to |
|---|
| 41 | 41 | | provide information relating to the number of units and the |
|---|
| 42 | 42 | | occupancy of each unit in a housing development as a condition of |
|---|
| 43 | 43 | | receiving or retaining a housing tax credit under this chapter. |
|---|
| 44 | 44 | | SECTION 3. The Texas Department of Housing and Community |
|---|
| 45 | 45 | | Affairs shall develop the method for collecting information |
|---|
| 46 | 46 | | relating to the occupancy of multiunit residential properties as |
|---|
| 47 | 47 | | required by Section 2306.189, Government Code, as added by this |
|---|
| 48 | 48 | | Act, not later than January 1, 2010. |
|---|
| 49 | 49 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 50 | 50 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 51 | 51 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 52 | 52 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 53 | 53 | | Act takes effect September 1, 2009. |
