66 AN ACT
77 relating to prohibiting the use of opt-out notices by businesses to
88 obtain the consent of consumers to transfer or share their personal
99 identifying information.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle C, Title 5, Business & Commerce Code, is
1212 amended by adding Chapter 106 to read as follows:
1313 CHAPTER 106. CONSENT FOR USE OF CONSUMER'S
1414 IDENTIFYING INFORMATION
1515 Sec. 106.001. DEFINITIONS. In this chapter:
1616 (1) "Consumer" means an individual who seeks to
1717 acquire or acquires goods or services for personal, family, or
1818 household purposes.
1919 (2) "Financial institution" has the meaning assigned
2020 by Section 201.101, Finance Code.
2121 (3) "Personal identifying information" means
2222 information that alone or in conjunction with other information
2323 identifies an individual, including an individual's:
2424 (A) name, social security number, date of birth,
2525 or government-issued identification number;
2626 (B) mother's maiden name;
2727 (C) unique biometric data, including the
2828 individual's fingerprint, voiceprint, and retina or iris image;
2929 (D) unique electronic identification number,
3030 address, or routing code; and
3131 (E) telecommunication access device.
3232 (4) "Telecommunication access device" has the meaning
3333 assigned by Section 32.51, Penal Code.
3434 Sec. 106.002. CONSENT REQUIRED FOR PERSONAL IDENTIFYING
3535 INFORMATION. A person engaged in business in this state, other than
3636 a financial institution, may not share or sell or otherwise
3737 transfer the personal identifying information of a consumer without
3838 the consumer's consent.
3939 Sec. 106.003. CONSENT NOT BASED SOLELY ON FAILURE TO
4040 RESPOND TO OPT-OUT NOTICE. Consent under Section 106.002 may not be
4141 based solely on the consumer's failure to respond to an opt-out
4242 notice or other notification sent by the person seeking consent
4343 that requires a positive response on the part of the consumer to
4444 deny consent.
4545 Sec. 106.004. EXCEPTION. This chapter does not apply to
4646 personal identifying information shared or transferred in
4747 compliance with:
4848 (1) procedures established under federal or state law;
4949 or
5050 (2) a court order, including a subpoena.
5151 Sec. 106.005. AGREEMENT NOT ENFORCEABLE. A contract or
5252 other agreement based on the consent of a consumer that is obtained
5353 in a manner that violates this chapter is void and unenforceable.
5454 SECTION 2. Subtitle Z, Title 3, Finance Code, is amended by
5555 adding Chapter 279 to read as follows:
5656 CHAPTER 279. CONSENT FOR USE OF CONSUMER'S
5757 IDENTIFYING INFORMATION
5858 Sec. 279.001. DEFINITIONS. In this chapter:
5959 (1) "Consumer" means an individual who seeks to
6060 acquire or acquires goods or services for personal, family, or
6161 household purposes.
6262 (2) "Financial institution" has the meaning assigned
6363 by Section 201.101.
6464 (3) "Personal identifying information" means
6565 information that alone or in conjunction with other information
6666 identifies an individual, including an individual's:
6767 (A) name, social security number, date of birth,
6868 or government-issued identification number;
6969 (B) mother's maiden name;
7070 (C) unique biometric data, including the
7171 individual's fingerprint, voiceprint, and retina or iris image;
7272 (D) unique electronic identification number,
7373 address, or routing code; and
7474 (E) telecommunication access device.
7575 (4) "Telecommunication access device" has the meaning
7676 assigned by Section 32.51, Penal Code.
7777 Sec. 279.002. CONSENT REQUIRED FOR PERSONAL IDENTIFYING
7878 INFORMATION. A financial institution may not share or sell or
7979 otherwise transfer the personal identifying information of a
8080 consumer without the consumer's consent.
8181 Sec. 279.003. CONSENT NOT BASED SOLELY ON FAILURE TO
8282 RESPOND TO OPT-OUT NOTICE. Consent under Section 279.002 may not be
8383 based solely on the consumer's failure to respond to an opt-out
8484 notice or other notification sent by the financial institution
8585 seeking consent that requires a positive response on the part of the
8686 consumer to deny consent.
8787 Sec. 279.004. EXCEPTION. This chapter does not apply to
8888 personal identifying information shared or transferred in
8989 compliance with:
9090 (1) procedures established under federal or state law;
9191 or
9292 (2) a court order, including a subpoena.
9393 Sec. 279.005. AGREEMENT NOT ENFORCEABLE. A contract or

9696 SECTION 3. This Act takes effect September 1, 2009.
