77 relating to the issuance of grants by the Texas Water Development
88 Board for water and wastewater system improvements in economically
99 distressed areas.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 17.933(b) and (c), Water Code, are
1212 amended to read as follows:
1313 (b) In providing financial assistance to an applicant under
1414 this subchapter, the board may not provide to the applicant
1515 financial assistance in the form of a grant [for which repayment is
1616 not required] in an amount that exceeds 50 percent of the total cost
1717 of a proposed project [amount of the financial assistance plus
1818 interest on any amount that must be repaid,] unless the Texas
1919 Department of State Health Services issues a determination
2020 [finding] that a nuisance dangerous to the public health and safety
2121 exists resulting from water supply and sanitation problems in the
2222 area to be served by the proposed project. The board and the
2323 applicant shall provide to the Texas Department of State Health
2424 Services information necessary to make a determination, and the
2525 board and the Texas Department of State Health Services may enter
2626 into necessary memoranda of understanding to carry out this
2727 subsection.
2828 (c) In providing financial assistance under this
2929 subchapter, the board may combine a grant made under this
3030 subchapter with a loan from any other source, including another
3131 program administered by the board [The total amount of financial
3232 assistance provided by the board to political subdivisions under
3333 this subchapter from state-issued bonds for which repayment is not
3434 required may not exceed at any time 90 percent of the total
3535 principal amount of issued and unissued bonds authorized under
3636 Article III of the Texas Constitution, for purposes of this
3737 subchapter plus outstanding interest on those bonds].
3838 SECTION 2. This Act takes effect September 1, 2009.
