| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Sections 17.933(b) and (c), Water Code, are |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (b) In providing financial assistance to an applicant under |
|---|
| 14 | 14 | | this subchapter, the board may not provide to the applicant |
|---|
| 15 | 15 | | financial assistance in the form of a grant [for which repayment is |
|---|
| 16 | 16 | | not required] in an amount that exceeds 50 percent of the total cost |
|---|
| 17 | 17 | | of a proposed project [amount of the financial assistance plus |
|---|
| 18 | 18 | | interest on any amount that must be repaid,] unless the Texas |
|---|
| 19 | 19 | | Department of State Health Services issues a determination |
|---|
| 20 | 20 | | [finding] that a nuisance dangerous to the public health and safety |
|---|
| 21 | 21 | | exists resulting from water supply and sanitation problems in the |
|---|
| 22 | 22 | | area to be served by the proposed project. The board and the |
|---|
| 23 | 23 | | applicant shall provide to the Texas Department of State Health |
|---|
| 24 | 24 | | Services information necessary to make a determination, and the |
|---|
| 25 | 25 | | board and the Texas Department of State Health Services may enter |
|---|
| 26 | 26 | | into necessary memoranda of understanding to carry out this |
|---|
| 27 | 27 | | subsection. |
|---|
| 28 | 28 | | (c) In providing financial assistance under this |
|---|
| 29 | 29 | | subchapter, the board may combine a grant made under this |
|---|
| 30 | 30 | | subchapter with a loan from any other source, including another |
|---|
| 31 | 31 | | program administered by the board [The total amount of financial |
|---|
| 32 | 32 | | assistance provided by the board to political subdivisions under |
|---|
| 33 | 33 | | this subchapter from state-issued bonds for which repayment is not |
|---|
| 34 | 34 | | required may not exceed at any time 90 percent of the total |
|---|
| 35 | 35 | | principal amount of issued and unissued bonds authorized under |
|---|
| 36 | 36 | | Article III of the Texas Constitution, for purposes of this |
|---|
| 37 | 37 | | subchapter plus outstanding interest on those bonds]. |

| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2009. |
