| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 61.013, Election Code, as added by |
|---|
| 11 | 11 | | Chapter 1182, Acts of the 80th Legislature, Regular Session, 2007, |
|---|
| 12 | 12 | | is amended by adding Subsection (a-1) to read as follows: |
|---|
| 13 | 13 | | (a-1) This subsection applies to an election of a political |
|---|
| 14 | 14 | | subdivision other than a county. Notwithstanding Subsection (a), |
|---|
| 15 | 15 | | for an election of a political subdivision with a population of less |
|---|
| 16 | 16 | | than 1,500, other than an election that is held jointly with another |
|---|
| 17 | 17 | | election in which a federal office appears on the ballot, the |
|---|
| 18 | 18 | | political subdivision is not required to meet the requirements of |
|---|
| 19 | 19 | | Section 61.012(a)(1)(C) if the political subdivision: |
|---|
| 20 | 20 | | (1) allows for a reasonable accommodation for a voter |
|---|
| 21 | 21 | | with a disability in the manner provided by Subsection (b); |
|---|
| 22 | 22 | | (2) provides notice to the secretary of state in the |
|---|
| 23 | 23 | | manner required under Subsection (d)(1); and |
|---|
| 24 | 24 | | (3) includes in the notice of election: |
|---|
| 25 | 25 | | (A) a statement that the election will not meet |
|---|
| 26 | 26 | | the requirements for accessibility described by Section |
|---|
| 27 | 27 | | 61.012(a)(1)(C); and |
|---|
| 28 | 28 | | (B) a description of the process by which a voter |
|---|
| 29 | 29 | | with a disability may request a reasonable accommodation to vote in |
|---|
| 30 | 30 | | the election. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect September 1, 2009. |
