| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 121.007(a), Utilities Code, is amended | |
| 12 | 12 | to read as follows: | |
| 13 | 13 | (a) A person operating a natural gas pipeline, a liquefied | |
| 14 | 14 | natural gas pipeline, or an underground storage facility is not a | |
| 15 | 15 | gas utility if the person certifies to the railroad commission that | |
| 16 | 16 | the person uses the pipeline or underground storage facility solely | |
| 17 | 17 | to deliver natural gas or liquefied natural gas or the constituents | |
| 18 | 18 | of natural gas or liquefied natural gas: | |
| 19 | 19 | (1) to a liquefied natural gas marine terminal; | |
| 20 | 20 | (2) from a liquefied natural gas marine terminal to | |
| 21 | 21 | the owner of the gas or another person on behalf of the owner of the | |
| 22 | 22 | gas; [or] | |
| 23 | 23 | (3) that is acquired, liquefied, or sold by the person | |
| 24 | 24 | as necessary for the operation or maintenance of its facility that | |
| 25 | 25 | is excluded as a gas utility under this section; or | |
| 26 | 26 | (4) that has been stored for export. | |
| 27 | 27 | SECTION 2. This Act takes effect September 1, 2009. |
