| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter L, Chapter 43, Parks and Wildlife |
|---|
| 11 | 11 | | Code, is amended by adding Section 43.369 to read as follows: |
|---|
| 12 | 12 | | Sec. 43.369. DEER BREEDER DATABASE. (a) In this section, |
|---|
| 13 | 13 | | "database" means the deer breeder database established under this |
|---|
| 14 | 14 | | section. |
|---|
| 15 | 15 | | (b) The department in conjunction with the Texas Animal |
|---|
| 16 | 16 | | Health Commission shall develop and maintain a database to be |
|---|
| 17 | 17 | | shared by both agencies. The database must include the reporting |
|---|
| 18 | 18 | | data required to be provided by each deer breeder: |
|---|
| 19 | 19 | | (1) to the department under this subchapter; and |
|---|
| 20 | 20 | | (2) to the Texas Animal Health Commission. |
|---|
| 21 | 21 | | (c) To the extent possible, the department and the Texas |
|---|
| 22 | 22 | | Animal Health Commission shall share the database to eliminate the |
|---|
| 23 | 23 | | need for a deer breeder to submit duplicate reports to the two |
|---|
| 24 | 24 | | agencies. |
|---|
| 25 | 25 | | (d) The Parks and Wildlife Commission and the Texas Animal |
|---|
| 26 | 26 | | Health Commission, by rule, shall provide incentives to deer |
|---|
| 27 | 27 | | breeders whose cooperation results in reduced costs and increased |
|---|
| 28 | 28 | | efficiency by offering: |
|---|
| 29 | 29 | | (1) reduced fees for the deer breeder permit; and |
|---|
| 30 | 30 | | (2) a permit with an extended duration. |
|---|
| 31 | 31 | | (e) The Parks and Wildlife Commission and the Texas Animal |
|---|
| 32 | 32 | | Health Commission may adopt rules to implement this section. |
|---|
| 33 | 33 | | SECTION 2. The Parks and Wildlife Department and the Texas |
|---|
| 34 | 34 | | Animal Health Commission shall develop a preliminary version of the |
|---|
| 35 | 35 | | deer breeder database required by this Act not later than June 1, |
|---|
| 36 | 36 | | 2010. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2009. |
