66 AN ACT
77 relating to a program to provide financial incentives to students
88 who agree to teach mathematics or science in certain public
99 schools.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 61, Education Code, is amended by adding
1212 Subchapter FF to read as follows:
1313 SUBCHAPTER FF. FINANCIAL INCENTIVE PROGRAM TO PREPARE TEACHERS IN
1414 MATHEMATICS OR SCIENCE
1515 Sec. 61.9771. ESTABLISHMENT OF PROGRAM. The board shall
1616 establish a program to provide financial incentives such as tuition
1717 assistance or student loan repayment to:
1818 (1) assist persons to obtain certification to teach
1919 mathematics or science in a public secondary school in this state;
2020 and
2121 (2) facilitate the employment of those persons by a
2222 public secondary school in this state that has a shortage of
2323 teachers certified to teach in those fields.
2424 Sec. 61.9772. ELIGIBILITY. To be eligible to receive
2525 financial incentives under this subchapter, a person must:
2626 (1) apply to the board in the form and manner
2727 prescribed by board rule;
2828 (2) have completed at least 60 semester credit hours
2929 of course work toward an associate's degree at a public junior
3030 college or a junior college accredited by a recognized accrediting
3131 agency;
3232 (3) be admitted into an educator preparation program
3333 at an institution of higher education that prepares students for
3434 certification to teach mathematics or science;
3535 (4) enter into an agreement with the board as provided
3636 by Section 61.9773; and
3737 (5) satisfy any other criteria jointly prescribed by
3838 the board and the State Board for Educator Certification.
3939 Sec. 61.9773. AGREEMENT. To qualify for financial
4040 incentives under this subchapter, a person must enter into a
4141 written agreement with the board as provided by this section. The
4242 agreement must require the person to:
4343 (1) obtain, within the period prescribed by board
4444 rule, certification to teach mathematics or science in a public
4545 secondary school in this state;
4646 (2) accept, during the first school year that begins
4747 after the date the person becomes certified, an offer of full-time
4848 employment to teach mathematics or science in a public secondary
4949 school in this state that has a shortage of teachers certified to
5050 teach in one or more of those fields; and
5151 (3) teach mathematics or science at that school for at
5252 least three school years.
5353 Sec. 61.9774. FINANCIAL INCENTIVES. The board shall award
5454 financial incentives such as tuition assistance or student loan
5555 repayment to each participant in the program to assist with the cost
5656 of payment of mandatory tuition and fees for courses required to
5757 obtain certification to teach mathematics or science.
5858 Sec. 61.9775. REIMBURSEMENT; EXCEPTIONS. (a) A program
5959 participant who fails to meet the requirements of Section 61.9773
6060 shall reimburse the board for the amount of any assistance received
6161 by the participant under this subchapter.
6262 (b) The board by rule shall establish exceptions to the
6363 reimbursement requirement under this section for participants who
6464 are unable to meet the requirements of Section 61.9773 as a result
6565 of an unusual hardship.
6666 Sec. 61.9776. GIFTS, GRANTS, AND DONATIONS. In addition to
6767 money appropriated by the legislature, the board may solicit and
6868 accept gifts, grants, and donations for the purposes of this
6969 subchapter.
7070 Sec. 61.9777. RULES. The board shall adopt rules necessary
7171 for the administration of this subchapter, including a rule that
7272 sets the maximum amount of financial assistance that a person may
7373 receive under this subchapter in one year.
7474 SECTION 2. The Texas Higher Education Coordinating Board
7575 shall adopt rules for the administration of Subchapter FF, Chapter
7676 61, Education Code, as added by this Act, as soon as practicable
7777 after this Act takes effect. For that purpose, the coordinating
7878 board may adopt the initial rules in the manner provided by law for
7979 emergency rules.
8080 SECTION 3. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2009.
