55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the duties of and qualifications for public school
88 principals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 11.202(b), Education Code, is amended to
1111 read as follows:
1212 (b) Each principal shall:
1313 (1) except as provided by Subsection (d), approve all
1414 teacher and staff appointments for that principal's campus from a
1515 pool of applicants selected by the district or of applicants who
1616 meet the hiring requirements established by the district, based on
1717 criteria developed by the principal after informal consultation
1818 with the faculty;
1919 (2) set specific education objectives for the
2020 principal's campus, through the planning process under Section
2121 11.253;
2222 (3) develop budgets for the principal's campus;
2323 (4) assume the administrative responsibility and
2424 instructional leadership, under the supervision of the
2525 superintendent, for discipline at the campus;
2626 (5) assign, evaluate, and promote personnel assigned
2727 to the campus;
2828 (6) recommend to the superintendent the termination or
2929 suspension of an employee assigned to the campus or the nonrenewal
3030 of the term contract of an employee assigned to the campus; [and]
3131 (7) ensure that each educator assigned to the campus
3232 receives appropriate and sufficient professional development;
3333 (8) ensure that each teacher assigned to the campus
3434 has the necessary educational and related materials for the teacher
3535 to accomplish the teacher's assigned duties;
3636 (9) ensure that the campus personnel, facilities, and
3737 grounds are managed in a manner that serves excellence in
3838 instruction in a safe and clean environment; and
3939 (10) perform other duties assigned by the
4040 superintendent pursuant to the policy of the board of trustees.
4141 SECTION 2. Section 21.046(b), Education Code, is amended to
4242 read as follows:
4343 (b) The qualifications for certification as a principal
4444 must be sufficiently flexible so that an outstanding teacher may
4545 qualify by substituting approved experience and professional
4646 training for part of the educational requirements. Supervised and
4747 approved on-the-job experience in addition to required internship
4848 shall be accepted in lieu of classroom hours. The qualifications
4949 must emphasize:
5050 (1) instructional leadership;
5151 (2) administration, supervision, and communication
5252 skills;
5353 (3) curriculum and instruction management;
5454 (4) performance evaluation;
5555 (5) organization; [and]
5656 (6) fiscal management;
5757 (7) professional development;
5858 (8) human resources management;
5959 (9) employment law; and
6060 (10) local, state, and national workplace safety
6161 standards.
6262 SECTION 3. This Act takes effect September 1, 2009.
