66 AN ACT
77 relating to the Governor's Mansion and Woodlawn.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 442.0071(a), (b), and (d), Government
1010 Code, are amended to read as follows:
1111 (a) Except as otherwise specifically provided by this
1212 section, the commission is solely responsible for the preservation
1313 and maintenance of the Governor's Mansion and the protection of the
1414 historical and architectural integrity of the mansion's exterior,
1515 interior, contents, and grounds. A [Except as provided by
1616 Subsection (d), a] substantial addition, deletion, or other
1717 alteration may not be made to the mansion or its contents or grounds
1818 without the prior approval of the commission.
1919 (b) The commission shall:
2020 (1) develop and maintain an inventory of the contents
2121 of the Governor's Mansion that includes all furnishings, fixtures,
2222 works of art, and decorative objects and states the owner of each of
2323 those items;
2424 (2) develop a plan for the acquisition, by purchase,
2525 donation, or loan, of furnishings, fixtures, works of art, and
2626 decorative objects for the mansion, especially early 19th-century
2727 American, museum-quality items and items having historical
2828 significance to the Governor's Mansion;
2929 (3) develop a plan for the disposition of furnishings,
3030 fixtures, works of art, and decorative objects that the commission
3131 determines are not needed or inappropriate; [and]
3232 (4) recommend and arrange for the conservation or
3333 restoration of furnishings, fixtures, works of art, and decorative
3434 objects in the mansion that are owned by the state; and
3535 (5) develop a plan for converting the Governor's
3636 Mansion, on acquisition of Woodlawn, into a public museum with
3737 facilities for the governor to host receptions and public events.
3838 (d) The commission shall solicit the advice and approval of
3939 the governor and the governor's spouse concerning activities of the
4040 commission under this section and the advice of the governor and the
4141 governor's spouse concerning the provisions of any contract
4242 executed under Subsection (c). [Except for a change in or to the
4343 Pease bedroom, the Sam Houston bedroom, the hallway, or the
4444 stairwell, a nonstructural decorative change in or to the private
4545 living and guest quarters of the governor and the governor's family
4646 on the second floor of the Governor's Mansion does not require the
4747 prior approval of the commission.]
4848 SECTION 2. Subchapter A, Chapter 442, Government Code, is
4949 amended by adding Section 442.0074 to read as follows:
5050 Sec. 442.0074. WOODLAWN. (a) The commission shall make
5151 every effort to acquire, at fair market value, title to the historic
5252 property Woodlawn, also commonly known as the Pease Mansion and the
5353 Shivers Mansion, located at No. 6 Niles Road in Austin. The
5454 remaining provisions of this section apply only if the commission
5555 acquires Woodlawn.
5656 (b) Once acquired, the property shall serve as the official
5757 residence of the governor.
5858 (c) Except as otherwise specifically provided by this
5959 section, the commission is solely responsible for the preservation
6060 and maintenance of Woodlawn and the protection of the historical
6161 and architectural integrity of the residence's exterior, interior,
6262 contents, and grounds.
6363 (d) The commission shall:
6464 (1) develop and maintain an inventory of the contents
6565 of Woodlawn that includes all furnishings, fixtures, works of art,
6666 and decorative objects and states the owner of each of those items;
6767 (2) develop a plan for the acquisition, by purchase,
6868 donation, or loan, of furnishings, fixtures, works of art, and
6969 decorative objects for the residence, especially museum-quality
7070 early 19th-century American items and items having historical
7171 significance to the official residence of the governor;
7272 (3) develop a plan for the disposition of furnishings,
7373 fixtures, works of art, and decorative objects that the commission
7474 determines are not needed or inappropriate; and
7575 (4) recommend and arrange for the conservation or
7676 restoration of furnishings, fixtures, works of art, and decorative
7777 objects in the residence that are or were owned by the state or a
7878 former governor of the state.
7979 (e) The commission may accept gifts, grants, or other
8080 donations on behalf of Woodlawn. The commission may contract with a
8181 nonprofit organization formed to assist in the preservation and
8282 maintenance of Woodlawn to develop and implement a plan for the
8383 solicitation and acceptance of gifts, grants, devises, and bequests
8484 of money, other property, and services to be used in the acquisition
8585 of furnishings, fixtures, works of art, and decorative objects for
8686 the residence or for necessary conservation or restoration
8787 services. The commission also may contract with a nonprofit
8888 organization described by this subsection for the performance of
8989 any duty provided by Subsection (d). A contract under this
9090 subsection may not exceed a term of two years and must expire on
9191 December 31 of an odd-numbered year.
9292 (f) The commission shall solicit the advice and approval of
9393 the governor and the governor's spouse concerning activities of the
9494 commission under this section and the advice of the governor and the
9595 governor's spouse concerning the provisions of any contract
9696 executed under Subsection (e).
9797 SECTION 3. Section 443.025, Government Code, is repealed.
9898 SECTION 4. This Act takes effect September 1, 2009.
