7 | 7 | | relating to the Governor's Mansion and Woodlawn. |
---|
8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Sections 442.0071(a), (b), and (d), Government |
---|
10 | 10 | | Code, are amended to read as follows: |
---|
11 | 11 | | (a) Except as otherwise specifically provided by this |
---|
12 | 12 | | section, the commission is solely responsible for the preservation |
---|
13 | 13 | | and maintenance of the Governor's Mansion and the protection of the |
---|
14 | 14 | | historical and architectural integrity of the mansion's exterior, |
---|
15 | 15 | | interior, contents, and grounds. A [Except as provided by |
---|
16 | 16 | | Subsection (d), a] substantial addition, deletion, or other |
---|
17 | 17 | | alteration may not be made to the mansion or its contents or grounds |
---|
18 | 18 | | without the prior approval of the commission. |
---|
19 | 19 | | (b) The commission shall: |
---|
20 | 20 | | (1) develop and maintain an inventory of the contents |
---|
21 | 21 | | of the Governor's Mansion that includes all furnishings, fixtures, |
---|
22 | 22 | | works of art, and decorative objects and states the owner of each of |
---|
23 | 23 | | those items; |
---|
24 | 24 | | (2) develop a plan for the acquisition, by purchase, |
---|
25 | 25 | | donation, or loan, of furnishings, fixtures, works of art, and |
---|
26 | 26 | | decorative objects for the mansion, especially early 19th-century |
---|
27 | 27 | | American, museum-quality items and items having historical |
---|
28 | 28 | | significance to the Governor's Mansion; |
---|
29 | 29 | | (3) develop a plan for the disposition of furnishings, |
---|
30 | 30 | | fixtures, works of art, and decorative objects that the commission |
---|
31 | 31 | | determines are not needed or inappropriate; [and] |
---|
32 | 32 | | (4) recommend and arrange for the conservation or |
---|
33 | 33 | | restoration of furnishings, fixtures, works of art, and decorative |
---|
34 | 34 | | objects in the mansion that are owned by the state; and |
---|
35 | 35 | | (5) develop a plan for converting the Governor's |
---|
36 | 36 | | Mansion, on acquisition of Woodlawn, into a public museum with |
---|
37 | 37 | | facilities for the governor to host receptions and public events. |
---|
38 | 38 | | (d) The commission shall solicit the advice and approval of |
---|
39 | 39 | | the governor and the governor's spouse concerning activities of the |
---|
40 | 40 | | commission under this section and the advice of the governor and the |
---|
41 | 41 | | governor's spouse concerning the provisions of any contract |
---|
42 | 42 | | executed under Subsection (c). [Except for a change in or to the |
---|
43 | 43 | | Pease bedroom, the Sam Houston bedroom, the hallway, or the |
---|
44 | 44 | | stairwell, a nonstructural decorative change in or to the private |
---|
45 | 45 | | living and guest quarters of the governor and the governor's family |
---|
46 | 46 | | on the second floor of the Governor's Mansion does not require the |
---|
47 | 47 | | prior approval of the commission.] |
---|
48 | 48 | | SECTION 2. Subchapter A, Chapter 442, Government Code, is |
---|
49 | 49 | | amended by adding Section 442.0074 to read as follows: |
---|
50 | 50 | | Sec. 442.0074. WOODLAWN. (a) The commission shall make |
---|
51 | 51 | | every effort to acquire, at fair market value, title to the historic |
---|
52 | 52 | | property Woodlawn, also commonly known as the Pease Mansion and the |
---|
53 | 53 | | Shivers Mansion, located at No. 6 Niles Road in Austin. The |
---|
54 | 54 | | remaining provisions of this section apply only if the commission |
---|
55 | 55 | | acquires Woodlawn. |
---|
56 | 56 | | (b) Once acquired, the property shall serve as the official |
---|
57 | 57 | | residence of the governor. |
---|
58 | 58 | | (c) Except as otherwise specifically provided by this |
---|
59 | 59 | | section, the commission is solely responsible for the preservation |
---|
60 | 60 | | and maintenance of Woodlawn and the protection of the historical |
---|
61 | 61 | | and architectural integrity of the residence's exterior, interior, |
---|
62 | 62 | | contents, and grounds. |
---|
63 | 63 | | (d) The commission shall: |
---|
64 | 64 | | (1) develop and maintain an inventory of the contents |
---|
65 | 65 | | of Woodlawn that includes all furnishings, fixtures, works of art, |
---|
66 | 66 | | and decorative objects and states the owner of each of those items; |
---|
67 | 67 | | (2) develop a plan for the acquisition, by purchase, |
---|
68 | 68 | | donation, or loan, of furnishings, fixtures, works of art, and |
---|
69 | 69 | | decorative objects for the residence, especially museum-quality |
---|
70 | 70 | | early 19th-century American items and items having historical |
---|
71 | 71 | | significance to the official residence of the governor; |
---|
72 | 72 | | (3) develop a plan for the disposition of furnishings, |
---|
73 | 73 | | fixtures, works of art, and decorative objects that the commission |
---|
74 | 74 | | determines are not needed or inappropriate; and |
---|
75 | 75 | | (4) recommend and arrange for the conservation or |
---|
76 | 76 | | restoration of furnishings, fixtures, works of art, and decorative |
---|
77 | 77 | | objects in the residence that are or were owned by the state or a |
---|
78 | 78 | | former governor of the state. |
---|
79 | 79 | | (e) The commission may accept gifts, grants, or other |
---|
80 | 80 | | donations on behalf of Woodlawn. The commission may contract with a |
---|
81 | 81 | | nonprofit organization formed to assist in the preservation and |
---|
82 | 82 | | maintenance of Woodlawn to develop and implement a plan for the |
---|
83 | 83 | | solicitation and acceptance of gifts, grants, devises, and bequests |
---|
84 | 84 | | of money, other property, and services to be used in the acquisition |
---|
85 | 85 | | of furnishings, fixtures, works of art, and decorative objects for |
---|
86 | 86 | | the residence or for necessary conservation or restoration |
---|
87 | 87 | | services. The commission also may contract with a nonprofit |
---|
88 | 88 | | organization described by this subsection for the performance of |
---|
89 | 89 | | any duty provided by Subsection (d). A contract under this |
---|
90 | 90 | | subsection may not exceed a term of two years and must expire on |
---|
91 | 91 | | December 31 of an odd-numbered year. |
---|
92 | 92 | | (f) The commission shall solicit the advice and approval of |
---|
93 | 93 | | the governor and the governor's spouse concerning activities of the |
---|
94 | 94 | | commission under this section and the advice of the governor and the |
---|
95 | 95 | | governor's spouse concerning the provisions of any contract |
---|
96 | 96 | | executed under Subsection (e). |
---|
97 | 97 | | SECTION 3. Section 443.025, Government Code, is repealed. |
---|
98 | 98 | | SECTION 4. This Act takes effect September 1, 2009. |
