| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 382.014, Health and Safety Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | Sec. 382.014. ELECTRONIC EMISSIONS DATABASE [EMISSION |
|---|
| 15 | 15 | | INVENTORY]. (a) The commission shall [may] require a person who |
|---|
| 16 | 16 | | holds a permit issued under this chapter [whose activities cause |
|---|
| 17 | 17 | | emissions of air contaminants] to annually submit information |
|---|
| 18 | 18 | | relating to: |
|---|
| 19 | 19 | | (1) permitted emissions; and |
|---|
| 20 | 20 | | (2) annual routine emissions associated with the |
|---|
| 21 | 21 | | permit [to enable the commission to develop an inventory of |
|---|
| 22 | 22 | | emissions of air contaminants in this state]. |
|---|
| 23 | 23 | | (b) The information submitted under Subsection (a) must be |
|---|
| 24 | 24 | | compiled into an existing online database such as the State of Texas |
|---|
| 25 | 25 | | Environmental Electronic Reporting System. Information submitted |
|---|
| 26 | 26 | | under this section must be: |
|---|
| 27 | 27 | | (1) publicly accessible; and |
|---|
| 28 | 28 | | (2) searchable by permit number. |
|---|
| 29 | 29 | | (c) The commission shall: |
|---|
| 30 | 30 | | (1) assess the emissions information received under |
|---|
| 31 | 31 | | this section annually; and |
|---|
| 32 | 32 | | (2) not later than December 1 of each year, submit to |
|---|
| 33 | 33 | | the governor, lieutenant governor, and speaker of the house of |
|---|
| 34 | 34 | | representatives a report of the assessment conducted under this |
|---|
| 35 | 35 | | subsection. |
|---|
| 36 | 36 | | SECTION 2. The Texas Commission on Environmental Quality |
|---|
| 37 | 37 | | shall develop and implement the electronic database required under |
|---|
| 38 | 38 | | Section 382.014, Health and Safety Code, as amended by this Act, not |
|---|
| 39 | 39 | | later than January 1, 2010. |
|---|
| 40 | 40 | | SECTION 3. (a) Except as provided by Subsection (b) of |
|---|
| 41 | 41 | | this section, this Act takes effect September 1, 2009. |

| 42 | 42 | | (b) Section 382.014(c), Health and Safety Code, as added by |
|---|
| 43 | 43 | | this Act, takes effect January 1, 2010. |
