55 relating to the operation of certain three-wheeled vehicles in this
66 state.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 521.001(a), Transportation Code, is
99 amended by adding Subdivision (6-a) to read as follows:
1010 (6-a) "Motorcycle" includes an enclosed three-wheeled
1111 passenger vehicle that:
1212 (A) is designed to operate with three wheels in
1313 contact with the ground;
1414 (B) has a minimum unladen weight of 900 lbs.;
1515 (C) has a single, completely enclosed, occupant
1616 compartment;
1717 (D) at a minimum, is equipped with:
1818 (i) seats that are certified by the vehicle
1919 manufacturer to meet the requirements of Federal Motor Vehicle
2020 Safety Standard No. 207, 49 C.F.R. Section 571.207;
2121 (ii) a steering wheel used to maneuver the
2222 vehicle;
2323 (iii) a propulsion unit located in front of
2424 or behind the enclosed occupant compartment;
2525 (iv) a seat belt for each vehicle occupant
2626 certified by the manufacturer to meet the requirements of Federal
2727 Motor Vehicle Safety Standard No. 209, 49 C.F.R. Section 571.209;
2828 (v) a windshield and one or more windshield
2929 wipers certified by the manufacturer to meet the requirements of
3030 Federal Motor Vehicle Safety Standard No. 205, 49 C.F.R. Section
3131 571.205, and Federal Motor Vehicle Safety Standard No. 104, 49
3232 C.F.R. Section 571.104; and
3333 (vi) a vehicle structure certified by the
3434 vehicle manufacturer to meet the requirements of Federal Motor
3535 Vehicle Safety Standard No. 216, 49 C.F.R. Section 571.216; and
3636 (E) is produced by its manufacturer in a minimum
3737 quantity of 300 in any calendar year.
3838 SECTION 2. Section 521.085, Transportation Code, is amended
3939 to read as follows:
4040 Sec. 521.085. TYPE OF VEHICLE AUTHORIZED. (a) Unless
4141 prohibited by Chapter 522, and except as provided by Subsection
4242 (b), the license holder may operate any vehicle of the type for
4343 which that class of license is issued and any lesser type of vehicle
4444 other than a motorcycle or moped.
4545 (b) Subsection (a) does not prohibit a license holder from
4646 operating a lesser type of vehicle that is a motorcycle described by
4747 Section 521.001(a)(6-a).
4848 SECTION 3. Section 661.001(1), Transportation Code, is
4949 amended to read as follows:
5050 (1) "Motorcycle" means a motor vehicle designed to
5151 propel itself with not more than three wheels in contact with the
5252 ground, and having a saddle for the use of the rider. The term does
5353 not include a tractor or a three-wheeled vehicle equipped with a cab
5454 or occupant compartment, seat, and seat belt and designed to
5555 contain the operator in the cab or occupant compartment.
5656 SECTION 4. Section 680.013, Transportation Code, is amended
5757 to read as follows:
5858 Sec. 680.013. USE OF PREFERENTIAL LANE BY MOTORCYCLE. A
5959 motorcycle, including a motorcycle described by Section
6060 521.001(a)(6-a), may be operated in a preferential lane that is not
6161 closed to all vehicular traffic.
6262 SECTION 5. This Act takes effect September 1, 2009.
