55 AN ACT
66 relating to certain personnel policies of the Texas Department of
77 Criminal Justice.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 493, Government Code, is amended by
1010 adding Section 493.026, to read as follows:
1111 Sec. 493.026. GRIEVANCE PROCEDURE. (a) In this section,
1212 "employment-related grievance" means an employment-related issue,
1313 in regard to which an employee wishes to express dissatisfaction,
1414 and includes issues relating to:
1515 (1) promotions;
1616 (2) leave requests;
1717 (3) performance evaluations;
1818 (4) transfers;
1919 (5) benefits;
2020 (6) working environment;
2121 (7) shift or duty assignments;
2222 (8) harassment;
2323 (9) retaliation;
2424 (10) disciplinary actions, including discharge,
2525 suspension, or demotion;
2626 (11) relationships with supervisors or other
2727 employees; and
2828 (12) any other issue which the board determines may be
2929 the subject of a grievance procedure.
3030 (b) The board shall establish procedures and practices
3131 through which the department will address employment-related
3232 grievances. The board shall adopt:
3333 (1) a form on which an employee may state an
3434 employment-related grievance and request a specific corrective
3535 action;
3636 (2) reasonable time limits for an employee to submit
3737 an employment-related grievance, and any subsequent appeals, and
3838 for management to respond to a grievance or appeal;
3939 (3) a three-step process by which an employee's
4040 employment-related grievance is submitted to the district
4141 supervisor, with a subsequent appeal submitted to a higher level in
4242 the chain of command, on completion of which the employee may choose
4343 to submit the grievance to binding arbitration with an impartial
4444 third party; and
4545 (4) a program to advertise and explain the grievance
4646 procedure to all employees.
4747 (c) If a party to the employment-related grievance fails to
4848 comply with the time limits adopted under Subsection (b)(2), the
4949 party may not prevail in the grievance action.
5050 (d) An employee may be represented by a person selected by
5151 the employee to participate in the employment-related grievance
5252 process on behalf of the employee. Any grievance proceeding in
5353 which a department employee serves as a representative shall be
5454 held during the normal business hours of the department, unless the
5555 employee and the department agree otherwise. Attending a grievance
5656 proceeding as a party to the proceeding or as a representative of a
5757 party is part of an employee's regular employment duties.
5858 (e) Subject to the approval of the employee in the
5959 employment-related grievance action, the department and the
6060 employee may enter into binding arbitration on the action. To
6161 facilitate arbitration, the department may:
6262 (1) with the approval of the employee, appoint a
6363 governmental officer or employee, or a private individual, to serve
6464 as an impartial third party in a binding arbitration; or
6565 (2) obtain the services of an impartial third party
6666 through:
6767 (A) an agreement with the Center for Public
6868 Policy Dispute Resolution of The University of Texas School of Law;
6969 (B) an alternative dispute resolution system
7070 created under Chapter 152, Civil Practices and Remedies Code;
7171 (C) another governmental body or a federal
7272 agency; or
7373 (D) an agreement with the State Office of
7474 Administrative Hearings.
7575 (f) The grievance action is confidential, except to the
7676 extent that Chapter 552 applies.
7777 (g) The department may not retaliate against an employee who
7878 files an employment-related grievance.
7979 (h) The department shall submit annually to the board a
8080 report on the department's use of the employment-related grievance
8181 process. The report shall include:
8282 (1) the number of grievances filed;
8383 (2) a brief description of each grievance filed; and
8484 (3) the final disposition of each grievance.
8585 SECTION 2. This Act takes effect September 1, 2009.
