| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 1305.353(d), Insurance Code, is amended |
|---|
| 9 | 9 | | to read as follows: |
|---|
| 10 | 10 | | (d) For services not described under Subsection (e) or (f), |
|---|
| 11 | 11 | | the determination under Subsection (c) must be issued and |
|---|
| 12 | 12 | | transmitted not later than the third working [calendar] day after |
|---|
| 13 | 13 | | the date the request is received. For the purposes of this |
|---|
| 14 | 14 | | subsection, "working day" has the meaning assigned by Section |
|---|
| 15 | 15 | | 4201.002. |
|---|
| 16 | 16 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 17 | 17 | | to review of a workers' compensation benefit requiring |
|---|
| 18 | 18 | | preauthorization under Chapter 1305, Insurance Code, that is |
|---|
| 19 | 19 | | initiated on or after the effective date of this Act. A review |
|---|
| 20 | 20 | | initiated before that date is governed by the law in effect on the |
|---|
| 21 | 21 | | date that the review was initiated, and the former law is continued |
|---|
| 22 | 22 | | in effect for that purpose. |

| 23 | 23 | | SECTION 3. This Act takes effect September 1, 2009. |
