99 relating to the purchase by state agencies of certain lamps.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 2158, Government Code, is
1212 amended by adding Section 2158.182 to read as follows:
1313 Sec. 2158.182. OUTDOOR LIGHTING FIXTURES; LAMPS. (a) This
1414 section applies only to the new installation of a lamp or the
1515 repair, renovation, or retrofit of a lamp no longer functioning
1616 properly for:
1717 (1) an outdoor lighting fixture installed or
1818 maintained on property owned, operated, maintained, or developed by
1919 the state; or
2020 (2) a lighting fixture at a state-owned parking
2121 facility.
2222 (b) A state agency, before purchasing a lamp to which this
2323 section applies, shall consider purchasing a lamp that:
2424 (1) achieves energy efficiency of at least 60 lumens
2525 per watt; and
2626 (2) has a life expectancy of at least 50,000 hours.
2727 SECTION 2. (a) In this section, "laboratory" means the
2828 Energy Systems Laboratory at the Texas Engineering Experiment
2929 Station of The Texas A&M University System.
3030 (b) The laboratory shall conduct a study of outdoor lighting
3131 fixtures used by state agencies. The study must examine:
3232 (1) types of outdoor lighting fixtures used by state
3333 agencies;
3434 (2) lighting technology that:
3535 (A) achieves substantial energy efficiency
3636 compared to currently used technology; and
3737 (B) has a life expectancy of at least 50,000
3838 hours;
3939 (3) price comparisons and return on investment
4040 standards for the lighting technologies studied; and
4141 (4) usage considerations as determined by the needs of
4242 individual state agencies.
4343 (c) At the laboratory's request, the Texas Facilities
4444 Commission shall provide assistance in conducting the study under
4545 this section.
4646 (d) At the laboratory's request, a state agency that has
4747 considered a lamp as required by Section 2158.182, Government Code,
4848 as added by this Act, shall provide data for use in conducting the
4949 study under this section.
5050 (e) Not later than September 1, 2010, the laboratory shall
5151 prepare a report regarding the results of the study conducted under
5252 this section, including the data collected and recommendations,
5353 and:
5454 (1) submit the report to the governor, the lieutenant
5555 governor, the speaker of the house of representatives, and the
5656 clerks of each of the standing committees of the senate and house of
5757 representatives with primary jurisdiction over state facilities;
5858 and
5959 (2) publish the report on the laboratory's Internet
6060 website or otherwise make the report available to the public
6161 through the Internet.
6262 SECTION 3. This Act takes effect September 1, 2009.
