| 9 | 9 | | relating to the purchase by state agencies of certain lamps. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter D, Chapter 2158, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 2158.182 to read as follows: |
|---|
| 13 | 13 | | Sec. 2158.182. OUTDOOR LIGHTING FIXTURES; LAMPS. (a) This |
|---|
| 14 | 14 | | section applies only to the new installation of a lamp or the |
|---|
| 15 | 15 | | repair, renovation, or retrofit of a lamp no longer functioning |
|---|
| 16 | 16 | | properly for: |
|---|
| 17 | 17 | | (1) an outdoor lighting fixture installed or |
|---|
| 18 | 18 | | maintained on property owned, operated, maintained, or developed by |
|---|
| 19 | 19 | | the state; or |
|---|
| 20 | 20 | | (2) a lighting fixture at a state-owned parking |
|---|
| 21 | 21 | | facility. |
|---|
| 22 | 22 | | (b) A state agency, before purchasing a lamp to which this |
|---|
| 23 | 23 | | section applies, shall consider purchasing a lamp that: |
|---|
| 24 | 24 | | (1) achieves energy efficiency of at least 60 lumens |
|---|
| 25 | 25 | | per watt; and |
|---|
| 26 | 26 | | (2) has a life expectancy of at least 50,000 hours. |
|---|
| 27 | 27 | | SECTION 2. (a) In this section, "laboratory" means the |
|---|
| 28 | 28 | | Energy Systems Laboratory at the Texas Engineering Experiment |
|---|
| 29 | 29 | | Station of The Texas A&M University System. |
|---|
| 30 | 30 | | (b) The laboratory shall conduct a study of outdoor lighting |
|---|
| 31 | 31 | | fixtures used by state agencies. The study must examine: |
|---|
| 32 | 32 | | (1) types of outdoor lighting fixtures used by state |
|---|
| 33 | 33 | | agencies; |
|---|
| 34 | 34 | | (2) lighting technology that: |
|---|
| 35 | 35 | | (A) achieves substantial energy efficiency |
|---|
| 36 | 36 | | compared to currently used technology; and |
|---|
| 37 | 37 | | (B) has a life expectancy of at least 50,000 |
|---|
| 38 | 38 | | hours; |
|---|
| 39 | 39 | | (3) price comparisons and return on investment |
|---|
| 40 | 40 | | standards for the lighting technologies studied; and |
|---|
| 41 | 41 | | (4) usage considerations as determined by the needs of |
|---|
| 42 | 42 | | individual state agencies. |
|---|
| 43 | 43 | | (c) At the laboratory's request, the Texas Facilities |
|---|
| 44 | 44 | | Commission shall provide assistance in conducting the study under |
|---|
| 45 | 45 | | this section. |
|---|
| 46 | 46 | | (d) At the laboratory's request, a state agency that has |
|---|
| 47 | 47 | | considered a lamp as required by Section 2158.182, Government Code, |
|---|
| 48 | 48 | | as added by this Act, shall provide data for use in conducting the |
|---|
| 49 | 49 | | study under this section. |
|---|
| 50 | 50 | | (e) Not later than September 1, 2010, the laboratory shall |
|---|
| 51 | 51 | | prepare a report regarding the results of the study conducted under |
|---|
| 52 | 52 | | this section, including the data collected and recommendations, |
|---|
| 53 | 53 | | and: |
|---|
| 54 | 54 | | (1) submit the report to the governor, the lieutenant |
|---|
| 55 | 55 | | governor, the speaker of the house of representatives, and the |
|---|
| 56 | 56 | | clerks of each of the standing committees of the senate and house of |
|---|
| 57 | 57 | | representatives with primary jurisdiction over state facilities; |
|---|
| 58 | 58 | | and |
|---|
| 59 | 59 | | (2) publish the report on the laboratory's Internet |
|---|
| 60 | 60 | | website or otherwise make the report available to the public |
|---|
| 61 | 61 | | through the Internet. |
|---|
| 62 | 62 | | SECTION 3. This Act takes effect September 1, 2009. |
