| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 341.0357(b), Health and Safety Code, as |
|---|
| 9 | 9 | | added by Chapter 861 (H.B. 1391), Acts of the 80th Legislature, |
|---|
| 10 | 10 | | Regular Session, 2007, is amended to read as follows: |
|---|
| 11 | 11 | | (b) The regulatory authority for a public utility shall by |
|---|
| 12 | 12 | | rule or ordinance adopt standards for installing fire hydrants and |
|---|
| 13 | 13 | | maintaining sufficient water pressure for service to fire hydrants |
|---|
| 14 | 14 | | adequate to protect public safety in residential areas in a |
|---|
| 15 | 15 | | municipality with a population of 1,000,000 or more. |
|---|
| 16 | 16 | | SECTION 2. Section 341.0358(b), Health and Safety Code, is |
|---|
| 17 | 17 | | amended to read as follows: |
|---|
| 18 | 18 | | (b) The regulatory authority for a public utility shall by |

| 26 | 26 | | (H.B. 3545 or S.B. 1969) does not become law. If the Act of the |

| 27 | 27 | | 81st Legislature, Regular Session, 2009, relating to |
|---|
| 28 | 28 | | nonsubstantive additions to and corrections in existing codes |
|---|
| 29 | 29 | | (H.B. 3545 or S.B. 1969) becomes law, Section 1 of this Act has no |
|---|
| 30 | 30 | | effect. |
|---|
| 31 | 31 | | (b) Section 2 of this Act takes effect only if the Act of the |
|---|
| 32 | 32 | | 81st Legislature, Regular Session, 2009, relating to |
|---|
| 33 | 33 | | nonsubstantive additions to and corrections in existing codes |
|---|
| 34 | 34 | | (H.B. 3545 or S.B. 1969) becomes law. If the Act of the 81st |
|---|
| 35 | 35 | | Legislature, Regular Session, 2009, relating to nonsubstantive |
|---|
| 36 | 36 | | additions to and corrections in existing codes (H.B. 3545 or |
|---|
| 37 | 37 | | S.B. 1969) does not become law, Section 2 of this Act has no effect. |

| 38 | 38 | | SECTION 4. This Act takes effect September 1, 2009. |
