| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 352.002, Tax Code, is amended by adding |
|---|
| 9 | 9 | | Subsection (k) to read as follows: |
|---|
| 10 | 10 | | (k) The commissioners court of a county with a population of |
|---|
| 11 | 11 | | more than 20,000 that is bordered by the Neches and Trinity Rivers |
|---|
| 12 | 12 | | and that contains portions of the Davy Crockett National Forest may |
|---|
| 13 | 13 | | impose a tax as provided by Subsection (a). |
|---|
| 14 | 14 | | SECTION 2. Section 352.002(f), Tax Code, as added by |
|---|
| 15 | 15 | | Chapter 749 (H.B. 3132), Acts of the 80th Legislature, Regular |
|---|
| 16 | 16 | | Session, 2007, is amended to read as follows: |
|---|
| 17 | 17 | | (f) The commissioners court of a county that has a |
|---|
| 18 | 18 | | population of 150,000 or more and that is bordered by the Brazos and |
|---|
| 19 | 19 | | Navasota Rivers may impose a tax as provided by Subsection (a). |
|---|
| 20 | 20 | | [This subsection expires September 1, 2015.] |
|---|
| 21 | 21 | | SECTION 3. Section 352.003, Tax Code, is amended by adding |
|---|
| 22 | 22 | | Subsection (m) to read as follows: |
|---|
| 23 | 23 | | (m) The tax rate in a county authorized to impose the tax |
|---|
| 24 | 24 | | under Section 352.002(k) may not exceed two percent of the price |
|---|
| 25 | 25 | | paid for a room in a hotel. |
|---|
| 26 | 26 | | SECTION 4. Section 352.003(h), Tax Code, as added by |
|---|
| 27 | 27 | | Chapter 749 (H.B. 3132), Acts of the 80th Legislature, Regular |
|---|
| 28 | 28 | | Session, 2007, is amended to read as follows: |
|---|
| 29 | 29 | | (h) The tax rate in a county authorized to impose the tax |
|---|
| 30 | 30 | | under Section 352.002(f) may not exceed two percent of the price |
|---|
| 31 | 31 | | paid for a room in a hotel. [This subsection expires September 1, |
|---|
| 32 | 32 | | 2015.] |
|---|
| 33 | 33 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2009. |
