5	5	relating to the licensing requirements for a foreign-trained
6	6	physician applicant.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Sections 155.0031(c) and (d), Occupations Code,
9	9	are amended to read as follows:
10	10	(c) Applicants for a license must subscribe to an oath [in
11	11	writing before an officer authorized by law to administer oaths].
12	12	The written oath is part of the application.
13	13	(d) An applicant must present proof satisfactory to the
14	14	board that:
15	15	(1) each medical school attended by the applicant is
16	16	substantially equivalent to a Texas medical school as determined by
17	17	board rule; or
18	18	(2) the applicant is specialty board certified by a
19	19	specialty board organization acceptable to the board.
20	20	SECTION 2. Section 155.004, Occupations Code, is amended to
21	21	read as follows:
22	22	Sec. 155.004. ADDITIONAL ELIGIBILITY REQUIREMENTS FOR
23	23	GRADUATES OF CERTAIN FOREIGN MEDICAL SCHOOLS. A license applicant
24	24	who is a graduate of a medical school that is located outside the
25	25	United States and Canada must present proof satisfactory to the
26	26	board that the applicant:
27	27	(1) is a graduate of a school whose curriculum meets
28	28	the requirements for an unapproved medical school as determined by
29	29	a committee of experts selected by the Texas Higher Education
30	30	Coordinating Board;
31	31	(2) has successfully completed:
32	32	(A) at least three years of graduate medical
33	33	training in the United States or Canada that was approved by the
34	34	board; or
35	35	(B) at least two years of graduate medical
36	36	training in the United States or Canada that was approved by the
37	37	board and at least one year of graduate medical training outside the
38	38	United States or Canada that was approved for advanced standing by a
39	39	specialty board organization approved by the board;
40	40	(3) [is eligible for a license to practice medicine in
41	41	the country in which the school is located, except for any
42	42	citizenship requirements;
43	43	[(4)] holds a valid certificate issued by the
44	44	Educational Commission for Foreign Medical Graduates; and
45	45	(4) [(5)] is able to communicate in English.
46	46	SECTION 3. The change in law made by this Act applies only
47	47	to physician applicants submitting license applications under
48	48	Chapter 155, Occupations Code, on or after the effective date of
49	49	this Act. An application submitted before that date is covered by
50	50	the law as it existed immediately before the effective date of this
51	51	Act, and that law is continued in effect for that purpose.
52	52	SECTION 4. This Act takes effect September 1, 2009.
