7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Section 101.054, Civil Practice and Remedies | |
9 | 9 | Code, is amended to read as follows: | |
10 | 10 | Sec. 101.054. STATE MILITARY PERSONNEL. This chapter does | |
11 | 11 | not apply to a claim arising from the activities of the state | |
12 | 12 | military forces [when on active duty under the lawful orders of | |
13 | 13 | competent authority]. | |
14 | 14 | SECTION 2. The change in law made by this Act applies only | |
15 | 15 | to a cause of action that accrues on or after the effective date of | |
16 | 16 | this Act. A cause of action that accrues before the effective date | |
17 | 17 | of this Act is governed by the law in effect immediately before the | |
18 | 18 | effective date of this Act, and that law is continued in effect for | |
19 | 19 | that purpose. | |
20 | 20 | SECTION 3. This Act takes effect immediately if it receives | |
21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
24 | 24 | Act takes effect September 1, 2009. |
