10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 481.111(b), Health and Safety Code, is | |
12 | 12 | amended to read as follows: | |
13 | 13 | (b) The provisions of this chapter relating to the | |
14 | 14 | possession of denatured sodium pentobarbital, Telazol, or Ketamine | |
15 | 15 | do not apply to possession by personnel of a humane society or an | |
16 | 16 | animal control agency for the purpose of tranquilizing, sedating, | |
17 | 17 | or destroying injured, sick, homeless, or unwanted animals if the | |
18 | 18 | humane society or animal control agency is registered with the | |
19 | 19 | Federal Drug Enforcement Administration. The provisions of this | |
20 | 20 | chapter relating to the distribution of denatured sodium | |
21 | 21 | pentobarbital, Telazol, or Ketamine do not apply to a person | |
22 | 22 | registered as required by Subchapter C, who is distributing the | |
23 | 23 | substance for that purpose to a humane society or an animal control | |
24 | 24 | agency registered with the Federal Drug Enforcement | |
25 | 25 | Administration. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2009. |
