55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the meetings and records of certain property owners'
88 associations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 551.0015, Government Code, is amended by
1111 amending Subsection (a) and adding Subsection (c) to read as
1212 follows:
1313 (a) A property owners' association is subject to this
1414 chapter in the same manner as a governmental body:
1515 (1) if:
1616 (A) membership in the property owners'
1717 association is mandatory for owners or for a defined class of owners
1818 of private real property in a residential subdivision [defined
1919 geographic area in a county with a population of 2.8 million or more
2020 or in a county adjacent to a county with a population of 2.8 million
2121 or more]; and
2222 (B) the property owners' association has the
2323 power to make mandatory special assessments [for capital
2424 improvements] or mandatory regular assessments[; and
2525 [(C) the amount of the mandatory special or
2626 regular assessments is or has ever been based in whole or in part on
2727 the value at which the state or a local governmental body assesses
2828 the property for purposes of ad valorem taxation under Section 20,
2929 Article VIII, Texas Constitution]; or
3030 (2) if the property owners' association:
3131 (A) provides maintenance, preservation, and
3232 architectural control of residential and commercial property
3333 within a defined geographic area in a county with a population of
3434 2.8 million or more or in a county adjacent to a county with a
3535 population of 2.8 million or more; and
3636 (B) is a corporation that:
3737 (i) is governed by a board of trustees who
3838 may employ a general manager to execute the association's bylaws
3939 and administer the business of the corporation;
4040 (ii) does not require membership in the
4141 corporation by the owners of the property within the defined area;
4242 and
4343 (iii) was incorporated before January 1,
4444 2006.
4545 (c) In this section, "property owners' association,"
4646 "regular assessment," "residential subdivision," and "special
4747 assessment" have the meanings assigned by Section 209.002, Property
4848 Code.
4949 SECTION 2. Section 552.0036, Government Code, is amended to
5050 read as follows:
5151 Sec. 552.0036. CERTAIN PROPERTY OWNERS' ASSOCIATIONS
5252 SUBJECT TO LAW. (a) In this section, "property owners'
5353 association," "regular assessment," "residential subdivision," and
5454 "special assessment" have the meanings assigned by Section 209.002,
5555 Property Code.
5656 (b) A property owners' association is subject to this
5757 chapter in the same manner as a governmental body:
5858 (1) if:
5959 (A) membership in the property owners'
6060 association is mandatory for owners or for a defined class of owners
6161 of private real property in a residential subdivision [defined
6262 geographic area in a county with a population of 2.8 million or more
6363 or in a county adjacent to a county with a population of 2.8 million
6464 or more]; and
6565 (B) the property owners' association has the
6666 power to make mandatory special assessments [for capital
6767 improvements] or mandatory regular assessments[; and
6868 [(C) the amount of the mandatory special or
6969 regular assessments is or has ever been based in whole or in part on
7070 the value at which the state or a local governmental body assesses
7171 the property for purposes of ad valorem taxation under Section 20,
7272 Article VIII, Texas Constitution]; or
7373 (2) if the property owners' association:
7474 (A) provides maintenance, preservation, and
7575 architectural control of residential and commercial property
7676 within a defined geographic area in a county with a population of
7777 2.8 million or more or in a county adjacent to a county with a
7878 population of 2.8 million or more; and
7979 (B) is a corporation that:
8080 (i) is governed by a board of trustees who
8181 may employ a general manager to execute the association's bylaws
8282 and administer the business of the corporation;
8383 (ii) does not require membership in the
8484 corporation by the owners of the property within the defined area;
8585 and
8686 (iii) was incorporated before January 1,
8787 2006.
8888 SECTION 3. Section 209.005, Property Code, is repealed.
8989 SECTION 4. (a) Section 551.0015, Government Code, as
9090 amended by this Act, applies only to a property owners' association
9191 meeting that is held on or after September 1, 2009. A property
9292 owners' association meeting that is held before September 1, 2009,
9393 is governed by the law in effect at the time the meeting was held,
9494 and that law is continued in effect for that purpose.
9595 (b) Section 552.0036, Government Code, as amended by this
9696 Act, applies only to a request for records or information made to a
9797 property owners' association on or after September 1, 2009. A
9898 request for records or information that is made before September 1,
9999 2009, is governed by the law in effect at the time the request was
100100 made, and that law is continued in effect for that purpose.
101101 (c) A request for access to records or information under
102102 Section 209.005, Property Code, as that section existed before
103103 repeal by this Act, that is made before September 1, 2009, is
104104 governed by the law in effect at the time the request was made, and
105105 that law is continued in effect for that purpose.
106106 SECTION 5. This Act takes effect September 1, 2009.
