 A BILL TO BE ENTITLED
 AN ACT
 relating to reports of certain information regarding the sale of
 alcoholic beverages to certain alcoholic beverage permit holders.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Chapter 23, Alcoholic Beverage Code, is amended
 by adding Section 23.07 to read as follows:
 Sec. 23.07.  REPORTING REQUIREMENT. For the purposes of
 protecting the public health and performing the commission's duties
 under Section 5.31(b), the commission by rule shall require the
 holder of a local distributor's permit to report to the commission
 each month:
 (1)  the volume, size, and brand of each alcoholic
 beverage sold by the permit holder to the holder of a private club
 registration permit or a mixed beverage permit during the month
 preceding the date of the report; and
 (2)  the name of each private club registration permit
 holder or mixed beverage permit holder that purchased alcoholic
 beverages from the local distributor during the month preceding the
 date of the report.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
