99 relating to the Port of Corpus Christi Authority of Nueces County,
1010 Texas.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 397, Acts of the 68th Legislature,
1313 Regular Session, 1983, is amended by adding Sections 1A, 4B, and 4C
1414 to read as follows:
1515 Sec. 1A. DEFINITIONS. In this Act:
1616 (1) "Authority" means the Port of Corpus Christi
1717 Authority of Nueces County, Texas.
1818 (2) "Port commission" means the governing body of the
1919 Port of Corpus Christi Authority of Nueces County, Texas.
2020 (3) "Port commissioner" means a member of the port
2121 commission.
2222 Sec. 4B. ELECTIONS. An election relating to the authority
2323 shall be held in the authority as a whole, and not on a
2424 county-by-county basis.
2525 Sec. 4C. SECURITY AND LAW ENFORCEMENT. (a) The port
2626 commission may adopt, amend, repeal, and enforce an ordinance,
2727 rule, or police regulation necessary to:
2828 (1) protect, secure, and defend the ship channels and
2929 waterways in the jurisdiction of the authority and facilities
3030 served by those ship channels and waterways;
3131 (2) promote the health, safety, and general welfare of
3232 any person using the ship channels and waterways in the
3333 jurisdiction of the authority; or
3434 (3) comply with a federal law or regulation or
3535 implement a directive or standard of the federal government,
3636 including the United States Department of Homeland Security and the
3737 United States Coast Guard, relating to securing ship channels and
3838 waterways and facilities served by ship channels and waterways and
3939 preventing terrorist attacks on ship channels, waterways,
4040 associated maritime facilities, and other facilities served by ship
4141 channels and waterways.
4242 (b) In the enforcement of an authority ordinance, rule, or
4343 police regulation, a sheriff, constable, or other duly constituted
4444 peace officer of this state or a peace officer employed or appointed
4545 by the port commission may make arrests, serve criminal warrants,
4646 subpoenas, or writs, and perform any other service or duty that may
4747 be performed by any sheriff, constable, or other duly constituted
4848 peace officer of this state in enforcing other laws of this state.
4949 (c) In adopting an ordinance, rule, or police regulation
5050 under Subsection (a) of this section, the port commission shall
5151 comply with the procedures provided by Sections 60.074 and 60.075,
5252 Water Code.
5353 (d) The authority may enter into an interlocal agreement
5454 with this state or a county, municipality, or other political
5555 subdivision of this state to jointly provide, and share the costs
5656 of, security for the ship channels and waterways in the
5757 jurisdiction of the authority.
5858 (e) To protect the public interest, the authority may
5959 contract with a qualified party, including the federal government,
6060 Nueces County, or San Patricio County, for the provision of law
6161 enforcement services in all or part of the jurisdiction of the
6262 authority.
6363 SECTION 2. This Act takes effect immediately if it receives
6464 a vote of two-thirds of all the members elected to each house, as
6565 provided by Section 39, Article III, Texas Constitution. If this
6666 Act does not receive the vote necessary for immediate effect, this
6767 Act takes effect September 1, 2009.
