44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to civil liability for selling or serving alcoholic
77 beverages.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 33.002(c), Civil Practice and Remedies
1010 Code, is amended to read as follows:
1111 (c) This chapter does not apply to:
1212 (1) an action to collect workers' compensation
1313 benefits under the workers' compensation laws of this state
1414 (Subtitle A, Title 5, Labor Code) or actions against an employer for
1515 exemplary damages arising out of the death of an employee;
1616 (2) a claim for exemplary damages included in an
1717 action to which this chapter otherwise applies; [or]
1818 (3) a cause of action for damages arising from the
1919 manufacture of methamphetamine as described by Chapter 99; or
2020 (4) an action under Chapter 2 or Chapter 106,
2121 Alcoholic Beverage Code.
2222 SECTION 2. The change in law made by this Act applies to an
2323 action filed on or after the effective date of this Act or pending
2424 on the effective date of this Act.
2525 SECTION 3. This Act takes effect September 1, 2009.
