8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 33.002(c), Civil Practice and Remedies | |
10 | 10 | Code, is amended to read as follows: | |
11 | 11 | (c) This chapter does not apply to: | |
12 | 12 | (1) an action to collect workers' compensation | |
13 | 13 | benefits under the workers' compensation laws of this state | |
14 | 14 | (Subtitle A, Title 5, Labor Code) or actions against an employer for | |
15 | 15 | exemplary damages arising out of the death of an employee; | |
16 | 16 | (2) a claim for exemplary damages included in an | |
17 | 17 | action to which this chapter otherwise applies; [or] | |
18 | 18 | (3) a cause of action for damages arising from the | |
19 | 19 | manufacture of methamphetamine as described by Chapter 99; or | |
20 | 20 | (4) an action under Chapter 2 or Chapter 106, | |
21 | 21 | Alcoholic Beverage Code. | |
22 | 22 | SECTION 2. The change in law made by this Act applies to an | |
23 | 23 | action filed on or after the effective date of this Act or pending | |
24 | 24 | on the effective date of this Act. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2009. |
