77 relating to the authority of officers in certain counties to
88 designate a person to receive fees, commissions, or costs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 114.001(a), Local Government Code, is
1111 amended to read as follows:
1212 (a) Each report required under this subtitle must be made in
1313 writing and must be sworn to before an officer authorized to
1414 administer oaths by the officer making the report or by a person
1515 designated by the officer to receive fees, commissions, or costs
1616 under Section 114.041(b) [before an officer authorized to
1717 administer oaths].
1818 SECTION 2. Section 114.041(b), Local Government Code, is
1919 amended to read as follows:
2020 (b) In a county with a population of more than 190,000, a
2121 district, county, or precinct officer shall keep, as part of a
2222 record provided for the purpose by the proper county authorities, a
2323 statement of the amounts earned by the officer and of the money
2424 received by the officer as fees, commissions, or costs. The officer
2525 may designate a person to receive the money as fees, commissions, or
2626 costs on behalf of the officer under this subsection. The officer
2727 or a person designated by the officer to receive the fees,
2828 commissions, or costs must make an entry in the record when the
2929 fees, commissions, or costs are earned and when they are received.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2009.
