6 | 6 | | relating to the insurance code to include members of a junior |

7 | 7 | | college board. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 1551.101, Insurance Code is amended by |
---|
10 | 10 | | adding Subsections (c) and (d) and amending Subsection (e) as |
---|
11 | 11 | | follows: |
---|
12 | 12 | | Sec. 1551.101. PARTICIPATION ELIGIBILITY: STATE OFFICERS |
---|
13 | 13 | | AND EMPLOYEES. (a) An elected or appointed officer or employee |
---|
14 | 14 | | who performs service, other than as an independent contractor, for |
---|
15 | 15 | | this state, including an institution of higher education, and who |
---|
16 | 16 | | is described by this section is eligible to participate in the group |
---|
17 | 17 | | benefits program as an employee on the date specified by Section |
---|
18 | 18 | | 1551.1055. |
---|
19 | 19 | | (b) An individual is eligible to participate in the group |
---|
20 | 20 | | benefits program as provided by Subsection (a) if the individual |
---|
21 | 21 | | receives compensation for service performed for this state pursuant |
---|
22 | 22 | | to a payroll certified by a state agency, other than an institution |
---|
23 | 23 | | of higher education, or by an elected or appointed officer of this |
---|
24 | 24 | | state, including a payment made from: |
---|
25 | 25 | | (1) an amount appropriated by the legislature from a |
---|
26 | 26 | | state fund; |
---|
27 | 27 | | (2) a trust fund held by the comptroller; or |
---|
28 | 28 | | (3) money paid under the official budget of a state |
---|
29 | 29 | | agency, other than money appropriated under a general |
---|
30 | 30 | | appropriations act. |
---|
31 | 31 | | (c) In addition to those covered in Subsection (a) and (b) |
---|
32 | 32 | | an individual who is a member of the governing body of a public |
---|
33 | 33 | | junior college; |
---|
34 | 34 | | (d) A member of a junior college board will be responsible |
---|
35 | 35 | | for payment of the benefits premium at the group rate of junior |
---|
36 | 36 | | college employees. |
---|
37 | 37 | | (e) An individual is eligible to participate in the group |
---|
38 | 38 | | benefits program as provided by Subsection (a) if the individual |
---|
39 | 39 | | receives compensation for service performed for an institution of |
---|
40 | 40 | | higher education pursuant to a payroll certified by an institution |
---|
41 | 41 | | of higher education or by an elected or appointed officer of this |
---|
42 | 42 | | state, or is a member of the governing board of a public junior |
---|
43 | 43 | | college; |
---|
44 | 44 | | (1) is eligible to become a member of the Teacher |
---|
45 | 45 | | Retirement System of Texas after any waiting period provided by law |
---|
46 | 46 | | before membership in that retirement system; or |
---|
47 | 47 | | (2) is employed at least 20 hours a week and is not |
---|
48 | 48 | | permitted to be a member of the Teacher Retirement System of Texas |
---|
49 | 49 | | because the individual is employed by an institution of higher |
---|
50 | 50 | | education only in a position that as a condition of employment |
---|
51 | 51 | | requires the individual to be enrolled as a student in the |
---|
52 | 52 | | institution in graduate-level courses. |
---|
53 | 53 | | SECTION 2. This Act takes effect immediately if it receives |
---|
54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
---|
55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
---|
57 | 57 | | Act takes effect September 1, 2009. |
