44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the insurance code to include members of a junior
77 college board.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1551.101, Insurance Code is amended by
1010 adding Subsections (c) and (d) and amending Subsection (e) as
1111 follows:
1212 Sec. 1551.101. PARTICIPATION ELIGIBILITY: STATE OFFICERS
1313 AND EMPLOYEES. (a) An elected or appointed officer or employee
1414 who performs service, other than as an independent contractor, for
1515 this state, including an institution of higher education, and who
1616 is described by this section is eligible to participate in the group
1717 benefits program as an employee on the date specified by Section
1818 1551.1055.
1919 (b) An individual is eligible to participate in the group
2020 benefits program as provided by Subsection (a) if the individual
2121 receives compensation for service performed for this state pursuant
2222 to a payroll certified by a state agency, other than an institution
2323 of higher education, or by an elected or appointed officer of this
2424 state, including a payment made from:
2525 (1) an amount appropriated by the legislature from a
2626 state fund;
2727 (2) a trust fund held by the comptroller; or
2828 (3) money paid under the official budget of a state
2929 agency, other than money appropriated under a general
3030 appropriations act.
3131 (c) In addition to those covered in Subsection (a) and (b)
3232 an individual who is a member of the governing body of a public
3333 junior college;
3434 (d) A member of a junior college board will be responsible
3535 for payment of the benefits premium at the group rate of junior
3636 college employees.
3737 (e) An individual is eligible to participate in the group
3838 benefits program as provided by Subsection (a) if the individual
3939 receives compensation for service performed for an institution of
4040 higher education pursuant to a payroll certified by an institution
4141 of higher education or by an elected or appointed officer of this
4242 state, or is a member of the governing board of a public junior
4343 college;
4444 (1) is eligible to become a member of the Teacher
4545 Retirement System of Texas after any waiting period provided by law
4646 before membership in that retirement system; or
4747 (2) is employed at least 20 hours a week and is not
4848 permitted to be a member of the Teacher Retirement System of Texas
4949 because the individual is employed by an institution of higher
5050 education only in a position that as a condition of employment
5151 requires the individual to be enrolled as a student in the
5252 institution in graduate-level courses.
5353 SECTION 2. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2009.
