| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 403, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subchapter O to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER O. GRANT PROGRAM FOR REPAIR OF COUNTY ROADS DAMAGED BY |
|---|
| 13 | 13 | | CERTAIN NATURAL GAS ACTIVITIES |
|---|
| 14 | 14 | | Sec. 403.351. GRANT PROGRAM FOR REPAIR OF COUNTY ROADS |
|---|
| 15 | 15 | | DAMAGED BY CERTAIN NATURAL GAS ACTIVITIES. (a) The comptroller by |
|---|
| 16 | 16 | | rule shall establish a program under which the comptroller may |
|---|
| 17 | 17 | | award to a county a grant to be used to pay the cost of repairing |
|---|
| 18 | 18 | | county roads damaged by natural gas activities, including pad site |
|---|
| 19 | 19 | | preparation, rig mobilization, drilling operations, and rig |
|---|
| 20 | 20 | | removal, that are related to the Barnett Shale in this state and the |
|---|
| 21 | 21 | | Haynesville Shale in Louisiana. |
|---|
| 22 | 22 | | (b) A grant awarded under this section may be paid from any |
|---|
| 23 | 23 | | source available for that purpose, including: |
|---|
| 24 | 24 | | (1) gifts; |
|---|
| 25 | 25 | | (2) grants; and |
|---|
| 26 | 26 | | (3) money appropriated to the comptroller for the |
|---|
| 27 | 27 | | purposes of this subchapter, including money deposited to the |
|---|
| 28 | 28 | | credit of the general revenue fund under Chapter 201 or 202, Tax |
|---|
| 29 | 29 | | Code. |
|---|
| 30 | 30 | | Sec. 403.352. GRANT REQUIREMENTS. The rules adopted by the |
|---|
| 31 | 31 | | comptroller under Section 403.351 must provide that: |
|---|
| 32 | 32 | | (1) a county may receive a grant only if the county can |
|---|
| 33 | 33 | | provide documentation that the county's roads were significantly |
|---|
| 34 | 34 | | damaged by the natural gas activities described by Section 403.351; |
|---|
| 35 | 35 | | and |
|---|
| 36 | 36 | | (2) a county that receives a grant may use the grant |
|---|
| 37 | 37 | | only to repair the significant damage caused by the natural gas |
|---|
| 38 | 38 | | activities. |
|---|
| 39 | 39 | | Sec. 403.353. REPORT TO LEGISLATURE. Not later than |
|---|
| 40 | 40 | | December 1 of each even-numbered year, the comptroller shall submit |
|---|
| 41 | 41 | | a report to the legislature summarizing the activities of the |
|---|
| 42 | 42 | | comptroller under this subchapter. |
|---|
| 43 | 43 | | SECTION 2. This Act takes effect September 1, 2009. |
