55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to municipal regulation of the discharge of firearms and
88 certain other weapons.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 229.002, Local Government Code, is
1111 amended to read as follows:
1212 Sec. 229.002. REGULATION OF DISCHARGE OF WEAPON. A
1313 municipality may not apply a regulation relating to the discharge
1414 of firearms or other weapons in the extraterritorial jurisdiction
1515 of the municipality or in an area annexed by the municipality after
1616 September 1, 1981, if the firearm or other weapon is:
1717 (1) a shotgun, air rifle or pistol, BB gun, or bow and
1818 arrow discharged:
1919 (A) on a tract of land of 10 acres or more and
2020 more than:
2121 (i) 1,000 [150] feet from an [a residence
2222 or] occupied building, including a residence, located on another
2323 property; and
2424 (ii) 1,500 feet from:
2525 (a) an occupied building that is a
2626 school, day-care facility, nursing home facility, or adult day-care
2727 facility located on another property;
2828 (b) the property line of a public
2929 tract of land used for outdoor recreation;
3030 (c) the property line of a residential
3131 subdivision; and
3232 (d) the property line of a multifamily
3333 residential complex; and
3434 (B) in a manner not reasonably expected to cause
3535 a projectile to cross the boundary of the tract; or
3636 (2) a center fire or rim fire rifle or pistol of any
3737 caliber discharged:
3838 (A) on a tract of land of 50 acres or more and
3939 more than:
4040 (i) 1,000 [300] feet from an [a residence
4141 or] occupied building, including a residence, located on another
4242 property; and
4343 (ii) 1,500 feet from:
4444 (a) an occupied building that is a
4545 school, day-care facility, nursing home facility, or adult day-care
4646 facility located on another property;
4747 (b) the property line of a public
4848 tract of land used for outdoor recreation;
4949 (c) the property line of a residential
5050 subdivision; and
5151 (d) the property line of a multifamily
5252 residential complex; and
5353 (B) in a manner not reasonably expected to cause
5454 a projectile to cross the boundary of the tract.
5555 SECTION 2. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2009.
