| 7 | 7 | | relating to the Bexar Metropolitan Water District. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. DISTRICT TO BE DISSOLVED. The Bexar |
|---|
| 10 | 10 | | Metropolitan Water District shall be dissolved as provided by this |
|---|
| 11 | 11 | | Act. |
|---|
| 12 | 12 | | SECTION 2. TEMPORARY BOARD; APPOINTMENT. The term of each |
|---|
| 13 | 13 | | person who is serving as a director of the Bexar Metropolitan Water |
|---|
| 14 | 14 | | District on the effective date of this Act expires on that date. As |
|---|
| 15 | 15 | | soon as practicable after the effective date of this Act, the Bexar |
|---|
| 16 | 16 | | County Commissioners Court shall appoint five persons to serve as |
|---|
| 17 | 17 | | temporary directors for the purposes described by Section 3 of this |
|---|
| 18 | 18 | | Act. |
|---|
| 19 | 19 | | SECTION 3. TEMPORARY BOARD; DUTIES. (a) The temporary |
|---|
| 20 | 20 | | board appointed under Section 2 of this Act shall transfer or assign |
|---|
| 21 | 21 | | the rights and duties of the Bexar Metropolitan Water District |
|---|
| 22 | 22 | | associated with the provision of water services, including existing |
|---|
| 23 | 23 | | contracts, assets, and liabilities of the district, to one or more |
|---|
| 24 | 24 | | appropriate public entities in such a manner that service to the |
|---|
| 25 | 25 | | existing customers of the Bexar Metropolitan Water District is not |
|---|
| 26 | 26 | | interrupted. |
|---|
| 27 | 27 | | (b) All transfers and assignments under this section must be |
|---|
| 28 | 28 | | completed by January 1, 2011. |
|---|
| 29 | 29 | | SECTION 4. DISSOLUTION. (a) The Bexar Metropolitan Water |
|---|
| 30 | 30 | | District is dissolved on January 1, 2011. |
|---|
| 31 | 31 | | (b) Any unsatisfied debt or legally established liability |
|---|
| 32 | 32 | | of the district shall be a charge on the assets transferred until |
|---|
| 33 | 33 | | paid. |
|---|
| 34 | 34 | | SECTION 5. REPEALER. Effective January 1, 2011, Chapter |
|---|
| 35 | 35 | | 306, Acts of the 49th Legislature, Regular Session, 1945, is |
|---|
| 36 | 36 | | repealed. |
|---|
| 37 | 37 | | SECTION 6. EFFECTIVE DATE. This Act takes effect September |
|---|
| 38 | 38 | | 1, 2009. |
