| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 824.601, Government Code, is amended by | |
| 10 | 10 | adding Subsection (g) to read as follows: | |
| 11 | 11 | (g) The system may not withhold a monthly benefit payment | |
| 12 | 12 | under this section from a retiree who: | |
| 13 | 13 | (1) before January 1, 2009, retired under Section | |
| 14 | 14 | 824.202; | |
| 15 | 15 | (2) is employed by a school district or an | |
| 16 | 16 | open-enrollment charter school; and | |
| 17 | 17 | (3) is not an employee of a third-party entity. | |
| 18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
| 19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
| 20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
| 21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
| 22 | 22 | Act takes effect September 1, 2009. |
