66 AN ACT
77 relating to non-veterinary horse dentistry.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 801.004, Occupations Code, is amended to
1010 read as follows:
1111 Sec. 801.004. APPLICATION OF CHAPTER. This chapter does
1212 not apply to:
1313 (1) the treatment or care of an animal in any manner by
1414 the owner of the animal, an employee of the owner, or a designated
1515 caretaker of the animal, unless the ownership, employment, or
1616 designation is established with the intent to violate this chapter;
1717 (2) a person who performs an act prescribed by the
1818 board as an accepted livestock management practice, including:
1919 (A) castrating a male animal raised for human
2020 consumption;
2121 (B) docking or earmarking an animal raised for
2222 human consumption;
2323 (C) dehorning cattle;
2424 (D) aiding in the nonsurgical birth process of a
2525 large animal, as defined by board rule;
2626 (E) treating an animal for disease prevention
2727 with a nonprescription medicine or vaccine;
2828 (F) branding or identifying an animal in any
2929 manner;
3030 (G) artificially inseminating an animal,
3131 including training, inseminating, and compensating for services
3232 related to artificial insemination; [and]
3333 (H) shoeing a horse; and
3434 (I) floating a horse's teeth;
3535 (3) the performance of a cosmetic or production
3636 technique to reduce injury in poultry intended for human
3737 consumption;
3838 (4) the performance of a duty by a veterinarian's
3939 employee if:
4040 (A) the duty involves food production animals;
4141 (B) the duty does not involve diagnosis,
4242 prescription, or surgery;
4343 (C) the employee is under the direction and
4444 general supervision of the veterinarian; and
4545 (D) the veterinarian is responsible for the
4646 employee's performance;
4747 (5) the performance of an act by a person who is a
4848 full-time student of an accredited college of veterinary medicine
4949 or is a foreign graduate of a board-approved equivalent competency
5050 program for foreign veterinary graduates and who is participating
5151 in a board-approved extern or preceptor program if the act is
5252 performed under the direct supervision of a veterinarian employing
5353 the person;
5454 (6) an animal shelter employee who performs euthanasia
5555 in the course and scope of the person's employment if the person has
5656 successfully completed training in accordance with Chapter 829,
5757 Health and Safety Code;
5858 (7) a person who is engaged in a recognized
5959 state-federal cooperative disease eradication or control program
6060 or an external parasite control program while the person is
6161 performing official duties required by the program;
6262 (8) a person who, without expectation of compensation,
6363 provides emergency care in an emergency or disaster; or
6464 (9) a consultation given to a veterinarian in this
6565 state by a person who:
6666 (A) resides in another state; and
6767 (B) is lawfully qualified to practice veterinary
6868 medicine under the laws of that state.
6969 SECTION 2. This Act takes effect immediately if it receives
7070 a vote of two-thirds of all the members elected to each house, as
7171 provided by Section 39, Article III, Texas Constitution. If this
7272 Act does not receive the vote necessary for immediate effect, this
7373 Act takes effect September 1, 2009.
