| 6 | 6 | | relating to the operation of and requirements for expansion of |

| 7 | 7 | | certain open-enrollment charter schools. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 12.101, Education Code, is amended by |
|---|
| 10 | 10 | | amending Subsection (b) and adding Subsection (b-1) to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (b) The State Board of Education may grant a charter for an |
|---|
| 13 | 13 | | open-enrollment charter school only to an applicant that meets any |
|---|
| 14 | 14 | | financial, governing, and operational standards adopted by the |
|---|
| 15 | 15 | | commissioner under this subchapter. [The State Board of Education |
|---|
| 16 | 16 | | may not grant a total of more than 215 charters for an open |
|---|
| 17 | 17 | | enrollment charter school.] |
|---|
| 18 | 18 | | (b-1) A charter holder may establish one or more new |
|---|
| 19 | 19 | | open-enrollment charter school campuses under a charter without |
|---|
| 20 | 20 | | applying for authorization from the State Board of Education if: |
|---|
| 21 | 21 | | (1) the open-enrollment charter school district is |
|---|
| 22 | 22 | | rated as academically acceptable or higher under Subchapter D, |
|---|
| 23 | 23 | | Chapter 39; and |
|---|
| 24 | 24 | | (2) no campus operating under the charter has been |
|---|
| 25 | 25 | | rated as academically unacceptable for any two of the three |
|---|
| 26 | 26 | | preceding school years or such a campus has been closed; and |
|---|
| 27 | 27 | | (3) the charter holder provides written notice, in the |
|---|
| 28 | 28 | | time, manner, and form provided by commissioner rule, to the State |
|---|
| 29 | 29 | | Board of Education and the commissioner of the establishment of any |
|---|
| 30 | 30 | | campus under this subsection. |
|---|
| 31 | 31 | | SECTION 2. This act applies beginning with the 2009-2010 |
|---|
| 32 | 32 | | school year. |
|---|
| 33 | 33 | | SECTION 3. This act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | act takes effect September 1, 2009. |
