44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the operation of and requirements for expansion of
77 certain open-enrollment charter schools.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 12.101, Education Code, is amended by
1010 amending Subsection (b) and adding Subsection (b-1) to read as
1111 follows:
1212 (b) The State Board of Education may grant a charter for an
1313 open-enrollment charter school only to an applicant that meets any
1414 financial, governing, and operational standards adopted by the
1515 commissioner under this subchapter. [The State Board of Education
1616 may not grant a total of more than 215 charters for an open
1717 enrollment charter school.]
1818 (b-1) A charter holder may establish one or more new
1919 open-enrollment charter school campuses under a charter without
2020 applying for authorization from the State Board of Education if:
2121 (1) the open-enrollment charter school district is
2222 rated as academically acceptable or higher under Subchapter D,
2323 Chapter 39; and
2424 (2) no campus operating under the charter has been
2525 rated as academically unacceptable for any two of the three
2626 preceding school years or such a campus has been closed; and
2727 (3) the charter holder provides written notice, in the
2828 time, manner, and form provided by commissioner rule, to the State
2929 Board of Education and the commissioner of the establishment of any
3030 campus under this subsection.
3131 SECTION 2. This act applies beginning with the 2009-2010
3232 school year.
3333 SECTION 3. This act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 act does not receive the vote necessary for immediate effect, this
3737 act takes effect September 1, 2009.
