A BILL TO BE ENTITLED
AN ACT
Relating to closure of a roadway or lane during times of emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 545, Transportation Code is amended by
adding Section 545.158 to read as follows:
Section 545.158. Power of a fire department officer. (1)
An officer of a fire department, in performance of his or her
official duties, has the authority to close to traffic highway or
other roadway, as necessary to protect the safety of persons or
property.
(2) In order to promote the safe implementation of
this statute, the fire department officer shall utilize an official
fire department vehicle using visual signals that meet the
requirements of Sections 547.305 and 547.702, Transportation Code.
SECTION 2. This Act takes effect September 1, 2009.
