7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Section 545, Transportation Code is amended by | |
9 | 9 | adding Section 545.158 to read as follows: | |
10 | 10 | Section 545.158. Power of a fire department officer. (1) | |
11 | 11 | An officer of a fire department, in performance of his or her | |
12 | 12 | official duties, has the authority to close to traffic highway or | |
13 | 13 | other roadway, as necessary to protect the safety of persons or | |
14 | 14 | property. | |
15 | 15 | (2) In order to promote the safe implementation of | |
16 | 16 | this statute, the fire department officer shall utilize an official | |
17 | 17 | fire department vehicle using visual signals that meet the | |
18 | 18 | requirements of Sections 547.305 and 547.702, Transportation Code. | |
19 | 19 | SECTION 2. This Act takes effect September 1, 2009. |
