55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to developing a developmental education plan for students
88 entering public institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 61, Education Code, is
1111 amended by adding Section 61.07611 to read as follows:
1212 Sec. 61.07611. DEVELOPMENTAL EDUCATION PLAN; REPORT. (a) To
1313 serve students who require developmental education in an effective
1414 and cost-effective manner, the board shall develop a statewide plan
1515 for developmental education to be provided under Section 51.3062
1616 that:
1717 (1) assigns primary responsibility for developmental
1818 education to public junior colleges; and
1919 (2) provides for using technology, to the greatest
2020 extent practicable consistent with best practices, to provide
2121 developmental education to students.
2222 (b) In developing the developmental education plan, the
2323 board shall:
2424 (1) research issues related to developmental
2525 education;
2626 (2) study and develop best practices for successful
2727 developmental education programs, including through use of pilot
2828 programs; and
2929 (3) assess various methods of providing developmental
3030 education to students to determine which methods, if any, should be
3131 implemented on a statewide basis.
3232 (c) Developmental education under the plan must include:
3333 (1) technological delivery of developmental education
3434 courses that allows students to complete course work on any
3535 schedule;
3636 (2) diagnostic assessments to determine a student's
3737 specific educational needs to allow for appropriate developmental
3838 instruction;
3939 (3) modular developmental education course materials;
4040 (4) employment of tutors and instructional aides to
4141 supplement developmental education course instruction as needed
4242 for particular students;
4343 (5) an internal monitoring mechanism to:
4444 (A) measure time spent by a student on a
4545 particular assignment or on a module of course materials; and
4646 (B) identify a student's area of academic
4747 difficulty;
4848 (6) periodic updates of developmental education
4949 course materials; and
5050 (7) assessments after completion of a developmental
5151 education course to determine a student's readiness to enroll in
5252 freshman-level academic courses.
5353 (d) The developmental education plan must provide for:
5454 (1) ongoing training for developmental education
5555 program faculty members, tutors, and instructional aides at the
5656 institutions or other locations where those persons provide
5757 instruction; and
5858 (2) ongoing research and improvement of appropriate
5959 developmental education programs, including participation by a
6060 group of institution of higher education faculty members selected
6161 by the board, to:
6262 (A) monitor results of the programs;
6363 (B) identify successful and unsuccessful program
6464 components; and
6565 (C) identify possible solutions to program
6666 problems.
6767 (e) Not later than December 1, 2010, the board shall submit
6868 to the governor, lieutenant governor, speaker of the house of
6969 representatives, and the presiding officer of each legislative
7070 standing committee with primary jurisdiction over higher education
7171 a report concerning the initial development of the developmental
7272 education plan under this section, including any recommendations
7373 for redesign or reassignment among institutions of higher education
7474 of existing programs or implementation of new programs and, if
7575 appropriate, recommendations for legislation. This subsection
7676 expires January 1, 2011.
7777 SECTION 2. This Act takes effect immediately if it receives
7878 a vote of two-thirds of all the members elected to each house, as
7979 provided by Section 39, Article III, Texas Constitution. If this
8080 Act does not receive the vote necessary for immediate effect, this
8181 Act takes effect September 1, 2009.
