55 AN ACT
66 relating to suspending the goal for renewable energy.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 39.904, Utilities Code, is amended by
99 amending Subsection (n) to read as follows:
1010 (n) Notwithstanding any other provision of law, the
1111 commission shall have the authority to cap the price of renewable
1212 energy credits and may suspend the goal contained in Subsection (a)
1313 if such suspension is necessary to protect the reliability and
1414 operation of the grid. The commission shall suspend the goal
1515 contained in subsection (a) if a national renewable portfolio
1616 standard is enacted under federal law and such standard would, when
1717 combined with the goal in subsection (a), increase costs to
1818 consumers in this state.
1919 SECTION 2. This Act takes effect immediately if it receives
2020 a vote of two-thirds of all the members elected to each house, as
2121 provided by Section 39, Article III, Texas Constitution. If this
2222 Act does not receive the vote necessary for immediate effect, this
2323 Act takes effect September 1, 2009.
