| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 39.904, Utilities Code, is amended by | |
| 10 | 10 | amending Subsection (i) to read as follows: | |
| 11 | 11 | (i) Transmission service to a competitive renewable energy | |
| 12 | 12 | zone must be provided in a manner consistent with Subchapter A, | |
| 13 | 13 | Chapter 35. The total cost of transmission capacity approved by the | |
| 14 | 14 | commission under this section may not exceed five billion dollars. | |
| 15 | 15 | SECTION 2. This Act takes effect immediately if it receives | |
| 16 | 16 | a vote of two-thirds of all the members elected to each house, as | |
| 17 | 17 | provided by Section 39, Article III, Texas Constitution. If this | |
| 18 | 18 | Act does not receive the vote necessary for immediate effect, this | |
| 19 | 19 | Act takes effect September 1, 2009. |
