99 relating to railroad peace officers appointed by the public safety
1010 director of the Department of Public Safety.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 2.12, Code of Criminal Procedure, is
1313 amended to read as follows:
1414 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
1515 officers:
1616 (1) sheriffs, their deputies, and those reserve
1717 deputies who hold a permanent peace officer license issued under
1818 Chapter 1701, Occupations Code;
1919 (2) constables, deputy constables, and those reserve
2020 deputy constables who hold a permanent peace officer license issued
2121 under Chapter 1701, Occupations Code;
2222 (3) marshals or police officers of an incorporated
2323 city, town, or village, and those reserve municipal police officers
2424 who hold a permanent peace officer license issued under Chapter
2525 1701, Occupations Code;
2626 (4) rangers and officers commissioned by the Public
2727 Safety Commission and the Director of the Department of Public
2828 Safety;
2929 (5) investigators of the district attorneys', criminal
3030 district attorneys', and county attorneys' offices;
3131 (6) law enforcement agents of the Texas Alcoholic
3232 Beverage Commission;
3333 (7) each member of an arson investigating unit
3434 commissioned by a city, a county, or the state;
3535 (8) officers commissioned under Section 37.081,
3636 Education Code, or Subchapter E, Chapter 51, Education Code;
3737 (9) officers commissioned by the General Services
3838 Commission;
3939 (10) law enforcement officers commissioned by the
4040 Parks and Wildlife Commission;
4141 (11) airport police officers commissioned by a city
4242 with a population of more than 1.18 million that operates an airport
4343 that serves commercial air carriers;
4444 (12) airport security personnel commissioned as peace
4545 officers by the governing body of any political subdivision of this
4646 state, other than a city described by Subdivision (11), that
4747 operates an airport that serves commercial air carriers;
4848 (13) municipal park and recreational patrolmen and
4949 security officers;
5050 (14) security officers and investigators commissioned
5151 as peace officers by the comptroller;
5252 (15) officers commissioned by a water control and
5353 improvement district under Section 49.216, Water Code;
5454 (16) officers commissioned by a board of trustees
5555 under Chapter 54, Transportation Code;
5656 (17) investigators commissioned by the Texas Medical
5757 Board;
5858 (18) officers commissioned by the board of managers of
5959 the Dallas County Hospital District, the Tarrant County Hospital
6060 District, or the Bexar County Hospital District under Section
6161 281.057, Health and Safety Code;
6262 (19) county park rangers commissioned under
6363 Subchapter E, Chapter 351, Local Government Code;
6464 (20) investigators employed by the Texas Racing
6565 Commission;
6666 (21) officers commissioned under Chapter 554,
6767 Occupations Code;
6868 (22) officers commissioned by the governing body of a
6969 metropolitan rapid transit authority under Section 451.108,
7070 Transportation Code, or by a regional transportation authority
7171 under Section 452.110, Transportation Code;
7272 (23) investigators commissioned by the attorney
7373 general under Section 402.009, Government Code;
7474 (24) security officers and investigators commissioned
7575 as peace officers under Chapter 466, Government Code;
7676 (25) an officer employed by the Department of State
7777 Health Services under Section 431.2471, Health and Safety Code;
7878 (26) officers appointed by an appellate court under
7979 Subchapter F, Chapter 53, Government Code;
8080 (27) officers commissioned by the state fire marshal
8181 under Chapter 417, Government Code;
8282 (28) an investigator commissioned by the commissioner
8383 of insurance under Section 701.104, Insurance Code;
8484 (29) apprehension specialists and inspectors general
8585 commissioned by the Texas Youth Commission as officers under
8686 Sections 61.0451 and 61.0931, Human Resources Code;
8787 (30) officers appointed by the inspector general of
8888 the Texas Department of Criminal Justice under Section 493.019,
8989 Government Code;
9090 (31) investigators commissioned by the Commission on
9191 Law Enforcement Officer Standards and Education under Section
9292 1701.160, Occupations Code;
9393 (32) commission investigators commissioned by the
9494 Texas Private Security Board under Section 1702.061(f),
9595 Occupations Code;
9696 (33) the fire marshal and any officers, inspectors, or
9797 investigators commissioned by an emergency services district under
9898 Chapter 775, Health and Safety Code;
9999 (34) officers commissioned by the State Board of
100100 Dental Examiners under Section 254.013, Occupations Code, subject
101101 to the limitations imposed by that section; [and]
102102 (35) investigators commissioned by the Texas Juvenile
103103 Probation Commission as officers under Section 141.055, Human
104104 Resources Code; and
105105 (36) railroad peace officers appointed by the public
106106 safety director of the Department of Public Safety under Article
107107 2.121, subject to the limitations imposed by that article.
108108 SECTION 2. Article 2.121, Code of Criminal Procedure, is
109109 amended to read as follows:
110110 Art. 2.121. RAILROAD PEACE OFFICERS. (a) The public safety
111111 director of the Department of Public Safety may appoint [up to 250]
112112 railroad peace officers who are employed by a railroad company to
113113 aid law enforcement agencies in the protection of railroad property
114114 and the protection of the persons and property of railroad
115115 passengers and employees. Except as provided by Subsection (b),
116116 each appointed officer has all the powers, privileges, and
117117 immunities of a peace officer while carrying out duties as a
118118 railroad peace officer within the boundaries of this state.
119119 (b) [Except as provided by Subsection (c) of this article, a
120120 railroad peace officer may make arrests and exercise all authority
121121 given peace officers under this code when necessary to prevent or
122122 abate the commission of an offense involving injury to passengers
123123 and employees of the railroad or damage to railroad property or to
124124 protect railroad property or property in the custody or control of
125125 the railroad.
126126 [(c)] A railroad peace officer may [not] issue a traffic
127127 citation for a violation of Chapter 521, Transportation Code, or
128128 Subtitle C, Title 7, Transportation Code, only if the violation:
129129 (1) occurs on railroad property;
130130 (2) is a violation of a traffic sign, signal, or
131131 marking located on railroad property; or
132132 (3) immediately affects railroad operations.
133133 (c) [(d)] A railroad peace officer is not entitled to state
134134 benefits normally provided by the state to a peace officer.
135135 (d) [(e)] A person may not serve as a railroad peace officer
136136 for a railroad company unless:
137137 (1) the Texas Railroad Association submits the
138138 person's application for appointment and certification as a
139139 railroad peace officer to the public safety director of the
140140 Department of Public Safety and to the executive director of the
141141 Commission on Law Enforcement Officer Standards and Education;
142142 (2) the public safety director of the department
143143 issues the person a certificate of authority to act as a railroad
144144 peace officer; and
145145 (3) the executive director of the commission
146146 determines that the person meets minimum standards required of
147147 peace officers by the commission relating to competence,
148148 reliability, education, training, morality, and physical and
149149 mental health and issues the person a license as a railroad peace
150150 officer; and
151151 (4) the person has met all standards for certification
152152 as a peace officer by the Commission on Law Enforcement Officer
153153 Standards and Education.
154154 (e) [(f)] For good cause, the public safety director of the
155155 department may revoke a certificate of authority issued under this
156156 article and the executive director of the commission may revoke a
157157 license issued under this article. Termination of employment with
158158 a railroad company, or the revocation of a railroad peace officer
159159 license, constitutes [shall constitute] an automatic revocation of
160160 a certificate of authority to act as a railroad peace officer.
161161 (f) [(g)] A railroad company is liable for any act or
162162 omission by a person serving as a railroad peace officer for the
163163 company that is within the person's scope of employment. Neither
164164 the state nor any political subdivision or agency of the state is
165165 [shall be] liable for any act or omission by a person appointed as a
166166 railroad peace officer. The employing railroad company shall pay
167167 all [All] expenses incurred by the granting or revocation of a
168168 certificate of authority to act as a railroad peace officer [shall
169169 be paid by the employing railroad company].
170170 (g) [(h)] A railroad peace officer who is a member of a
171171 railroad craft may not perform the duties of a member of any other
172172 railroad craft during a strike or labor dispute.
173173 (h) [(i)] The public safety director of the department and
174174 the executive director of the commission may adopt [shall have the
175175 authority to promulgate] rules necessary for the effective
176176 administration and performance of the duties and responsibilities
177177 delegated to the directors [them] by this article.
178178 SECTION 3. This Act takes effect immediately if it receives
179179 a vote of two-thirds of all the members elected to each house, as
180180 provided by Section 39, Article III, Texas Constitution. If this
181181 Act does not receive the vote necessary for immediate effect, this
182182 Act takes effect September 1, 2009.
