55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the regulation of the towing of vehicles.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 2308.102, Occupations Code, is amended
1010 by amending Subsection (b) and adding Subsection (c) to read as
1111 follows:
1212 (b) Except as provided by Subsection (c), the [The]
1313 department may conduct an examination of any criminal conviction of
1414 an applicant, including by obtaining any criminal history record
1515 information permitted by law.
1616 (c) Subsection (b) does not apply to an application for a
1717 permit submitted by:
1818 (1) a private towing company that does not offer
1919 towing services for hire; or
2020 (2) a towing company that:
2121 (A) conducts at least 50 percent of its business
2222 in counties with populations of less than 50,000; and
2323 (B) has its primary office located in a county
2424 with a population of less than 50,000.
2525 SECTION 2. Section 2308.103, Occupations Code, is amended
2626 by amending Subsection (b) and adding Subsection (e) to read as
2727 follows:
2828 (b) To be eligible for an incident management towing permit,
2929 an applicant must submit evidence that:
3030 (1) the tow truck is equipped to tow light-duty or
3131 heavy-duty vehicles according to the manufacturer's towing
3232 guidelines;
3333 (2) the applicant has at least $500,000 of liability
3434 insurance for the tow truck; and
3535 (3) except as provided by Subsection (e), the
3636 applicant has at least $50,000 of cargo insurance for the tow truck.
3737 (e) Subsection (b)(3) does not apply to an application for a
3838 permit submitted by a towing company described by Section
3939 2308.102(c)(2).
4040 SECTION 3. Section 2308.104, Occupations Code, is amended
4141 by amending Subsection (b) and adding Subsection (e) to read as
4242 follows:
4343 (b) To be eligible for a private property towing permit, an
4444 applicant must submit evidence that:
4545 (1) the tow truck is equipped to tow light-duty or
4646 heavy-duty vehicles according to the manufacturer's towing
4747 guidelines;
4848 (2) the applicant has at least $300,000 of liability
4949 insurance for the tow truck; and
5050 (3) except as provided by Subsection (e), the
5151 applicant has at least $50,000 of cargo insurance for the tow truck.
5252 (e) Subsection (b)(3) does not apply to an application for a
5353 permit submitted by a towing company described by Section
5454 2308.102(c)(2).
5555 SECTION 4. Section 2308.153, Occupations Code, is amended
5656 by amending Subsection (b) and adding Subsection (c) to read as
5757 follows:
5858 (b) An applicant for an incident management towing
5959 operator's license must:
6060 (1) be a licensed Texas driver; and
6161 (2) except as provided by Subsection (c), be certified
6262 by the National Drivers Certification Program of the Towing and
6363 Recovery Association of America or another certification program
6464 approved by the department.
6565 (c) Subsection (b)(2) does not apply to an application for
6666 an incident management towing operator's license if the applicant
6767 will operate a tow truck permitted to a towing company described by
6868 Section 2308.102(c)(2).
6969 SECTION 5. Section 2308.154, Occupations Code, is amended
7070 by amending Subsection (b) and adding Subsection (c) to read as
7171 follows:
7272 (b) An applicant for a private property towing operator's
7373 license must:
7474 (1) be a licensed Texas driver; and
7575 (2) except as provided by Subsection (c), be certified
7676 by the National Drivers Certification Program of the Towing and
7777 Recovery Association of America or another certification program
7878 approved by the department.
7979 (c) Subsection (b)(2) does not apply to an application for a
8080 private property towing operator's license if the applicant will
8181 operate a tow truck permitted to a towing company described by
8282 Section 2308.102(c)(2).
8383 SECTION 6. This Act takes effect immediately if it receives
8484 a vote of two-thirds of all the members elected to each house, as
8585 provided by Section 39, Article III, Texas Constitution. If this
8686 Act does not receive the vote necessary for immediate effect, this
8787 Act takes effect September 1, 2009.
