55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain disputes involving residential construction
88 projects employing undocumented workers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 426.001, Property Code, is amended by
1111 amending Subsection (c) and adding Subsection (b-1) to read as
1212 follows:
1313 (b-1) Chapters 426 through 429 do not apply to a dispute if:
1414 (1) the builder or any subcontractor of the builder
1515 employs an undocumented worker for the construction project that is
1616 the subject of the dispute; and
1717 (2) the builder has registered 100 homes or more with
1818 the commission during the commission's preceding fiscal year.
1919 (c) For the purposes of this section:
2020 (1) "Damage[, "damage] to goods" does not include
2121 damage to a home.
2222 (2) "Undocumented worker" means a person who is not
2323 lawfully entitled to be present and employed in the United States.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2009.
