55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to persons authorized to receive certain medical or
88 treatment information.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 611, Health and Safety Code, is amended
1111 by adding Section 611.009 to read as follows:
1212 Sec. 611.009. APPLICATION FOR DISCLOSURE. (a) A person may
1313 apply to a county or district court with probate jurisdiction for a
1414 court order allowing access to confidential information relating to
1515 the patient if the person:
1616 (1) is a member of the patient's family or is the
1717 patient's caregiver;
1818 (2) provides financial, emotional, or other
1919 substantial support to the patient; and
2020 (3) enhances or facilitates the treatment, care, or
2121 well-being of the patient.
2222 (b) The court may deny access to any portion of a record if
2323 the court determines that release of that portion would be harmful
2424 to the patient's physical, mental, or emotional health.
2525 SECTION 2. This Act takes effect September 1, 2009.
