9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 611, Health and Safety Code, is amended | |
11 | 11 | by adding Section 611.009 to read as follows: | |
12 | 12 | Sec. 611.009. APPLICATION FOR DISCLOSURE. (a) A person may | |
13 | 13 | apply to a county or district court with probate jurisdiction for a | |
14 | 14 | court order allowing access to confidential information relating to | |
15 | 15 | the patient if the person: | |
16 | 16 | (1) is a member of the patient's family or is the | |
17 | 17 | patient's caregiver; | |
18 | 18 | (2) provides financial, emotional, or other | |
19 | 19 | substantial support to the patient; and | |
20 | 20 | (3) enhances or facilitates the treatment, care, or | |
21 | 21 | well-being of the patient. | |
22 | 22 | (b) The court may deny access to any portion of a record if | |
23 | 23 | the court determines that release of that portion would be harmful | |
24 | 24 | to the patient's physical, mental, or emotional health. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2009. |
