| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter G, Chapter 11, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 11.305 to read as follows: |
|---|
| 12 | 12 | | Sec. 11.305. JOINT ELECTIONS REQUIRED: COMMON SCHOOL |
|---|
| 13 | 13 | | DISTRICT. (a) Notwithstanding former Section 22.02, as it existed |
|---|
| 14 | 14 | | on May 1, 1995, an election for trustees of a common school district |
|---|
| 15 | 15 | | shall be held on the same date as: |
|---|
| 16 | 16 | | (1) the election for the members of the governing body |
|---|
| 17 | 17 | | of a municipality located in the school district; or |
|---|
| 18 | 18 | | (2) the general election for state and county |
|---|
| 19 | 19 | | officers. |
|---|
| 20 | 20 | | (b) Elections held on the same date as provided by |
|---|
| 21 | 21 | | Subsection (a) shall be held as a joint election under Chapter 271, |
|---|
| 22 | 22 | | Election Code. |
|---|
| 23 | 23 | | (c) The voters of a joint election under this section shall |
|---|
| 24 | 24 | | be served by common polling places consistent with Section |
|---|
| 25 | 25 | | 271.003(b), Election Code. |
|---|
| 26 | 26 | | (d) The board of trustees of a common school district |
|---|
| 27 | 27 | | changing an election date to comply with this section shall adjust |
|---|
| 28 | 28 | | the terms of office of its members to conform to the new election |
|---|
| 29 | 29 | | date. |
|---|
| 30 | 30 | | SECTION 2. Not later than December 31, 2009, the board of |
|---|
| 31 | 31 | | trustees of a common school district must: |
|---|
| 32 | 32 | | (1) change the date on which the school district holds |
|---|
| 33 | 33 | | its general election for trustees to allow the district to hold its |
|---|
| 34 | 34 | | election on the same date as the election for members of the |
|---|
| 35 | 35 | | governing body of a municipality located in the school district or |
|---|
| 36 | 36 | | on the same date as the general election for state and county |
|---|
| 37 | 37 | | officers, as required by Section 11.305, Education Code, as added |
|---|
| 38 | 38 | | by this Act; and |
|---|
| 39 | 39 | | (2) adjust the terms of office of school district |
|---|
| 40 | 40 | | trustees as necessary to conform to the change of the election date |
|---|
| 41 | 41 | | made under Subdivision (1) of this section. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect September 1, 2009. |
