88 AN ACT
99 relating to the election of the speaker of the house of
1010 representatives.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 302.001, Government Code, is amended to
1313 read as follows:
1414 Sec. 302.001. ELECTION. (a) When the house of
1515 representatives first convenes in regular session and a quorum is
1616 present and has been qualified, the house shall elect a speaker
1717 unless a majority of the members present decides to defer the
1818 election.
1919 (b) The election of the speaker shall be governed by the
2020 rules of the house of representatives.
2121 SECTION 2. Section 571.061(a), Government Code, is amended
2222 to read as follows:
2323 (a) The commission shall administer and enforce:
2424 (1) Chapters [302,] 303, 305, 572, and 2004;
2525 (2) Subchapter C, Chapter 159, Local Government Code,
2626 in connection with a county judicial officer, as defined by Section
2727 159.051, Local Government Code, who elects to file a financial
2828 statement with the commission;
2929 (3) Title 15, Election Code; and
3030 (4) Sections 2152.064 and 2155.003.
3131 SECTION 3. Section 571.091(a), Government Code, is amended
3232 to read as follows:
3333 (a) The commission shall prepare a written opinion
3434 answering the request of a person subject to any of the following
3535 laws for an opinion about the application of any of these laws to
3636 the person in regard to a specified existing or hypothetical
3737 factual situation:
3838 (1) [Chapter 302;
3939 [(2)] Chapter 303;
4040 (2) [(3)] Chapter 305;
4141 (3) [(4)] Chapter 2004;
4242 (4) [(5)] Chapter 572;
4343 (5) [(6)] Subchapter C, Chapter 159, Local Government
4444 Code, as provided by Section 571.061(a)(2);
4545 (6) [(7)] Title 15, Election Code;
4646 (7) [(8)] Chapter 36, Penal Code;
4747 (8) [(9)] Chapter 39, Penal Code;
4848 (9) [(10)] Section 2152.064; or
4949 (10) [(11)] Section 2155.003.
5050 SECTION 4. Subchapter B, Chapter 302, Government Code, is
5151 repealed.
5252 SECTION 5. (a) The repeal by this Act of Section 302.021,
5353 Government Code, does not apply to an offense committed under that
5454 section before September 1, 2009. For purposes of this section, an
5555 offense is committed before September 1, 2009, if any element of the
5656 offense occurs before that date.
5757 (b) An offense committed before September 1, 2009, is
5858 covered by that section as it existed when the offense was
5959 committed, and the former law is continued in effect for that
6060 purpose.
6161 SECTION 6. This Act takes effect September 1, 2009.
