11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 302.001, Government Code, is amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | Sec. 302.001. ELECTION. (a) When the house of |
---|
15 | 15 | | representatives first convenes in regular session and a quorum is |
---|
16 | 16 | | present and has been qualified, the house shall elect a speaker |
---|
17 | 17 | | unless a majority of the members present decides to defer the |
---|
18 | 18 | | election. |
---|
19 | 19 | | (b) The election of the speaker shall be governed by the |
---|
20 | 20 | | rules of the house of representatives. |
---|
21 | 21 | | SECTION 2. Section 571.061(a), Government Code, is amended |
---|
22 | 22 | | to read as follows: |
---|
23 | 23 | | (a) The commission shall administer and enforce: |
---|
24 | 24 | | (1) Chapters [302,] 303, 305, 572, and 2004; |
---|
25 | 25 | | (2) Subchapter C, Chapter 159, Local Government Code, |
---|
26 | 26 | | in connection with a county judicial officer, as defined by Section |
---|
27 | 27 | | 159.051, Local Government Code, who elects to file a financial |
---|
28 | 28 | | statement with the commission; |
---|
29 | 29 | | (3) Title 15, Election Code; and |
---|
30 | 30 | | (4) Sections 2152.064 and 2155.003. |
---|
31 | 31 | | SECTION 3. Section 571.091(a), Government Code, is amended |
---|
32 | 32 | | to read as follows: |
---|
33 | 33 | | (a) The commission shall prepare a written opinion |
---|
34 | 34 | | answering the request of a person subject to any of the following |
---|
35 | 35 | | laws for an opinion about the application of any of these laws to |
---|
36 | 36 | | the person in regard to a specified existing or hypothetical |
---|
37 | 37 | | factual situation: |

38 | 38 | | (1) [Chapter 302; |
---|
39 | 39 | | [(2)] Chapter 303; |
---|
40 | 40 | | (2) [(3)] Chapter 305; |
---|
41 | 41 | | (3) [(4)] Chapter 2004; |

50 | 50 | | SECTION 4. Subchapter B, Chapter 302, Government Code, is |

51 | 51 | | repealed. |

52 | 52 | | SECTION 5. (a) The repeal by this Act of Section 302.021, |
---|
53 | 53 | | Government Code, does not apply to an offense committed under that |
---|
54 | 54 | | section before September 1, 2009. For purposes of this section, an |
---|
55 | 55 | | offense is committed before September 1, 2009, if any element of the |
---|
56 | 56 | | offense occurs before that date. |
---|
57 | 57 | | (b) An offense committed before September 1, 2009, is |
---|
58 | 58 | | covered by that section as it existed when the offense was |
---|
59 | 59 | | committed, and the former law is continued in effect for that |
---|
60 | 60 | | purpose. |
---|
61 | 61 | | SECTION 6. This Act takes effect September 1, 2009. |
