| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 411.190, Government Code, is amended by | |
| 11 | 11 | adding Subsection (d-1) to read as follows: | |
| 12 | 12 | (d-1) The department shall ensure that an applicant may | |
| 13 | 13 | renew certification under Subsection (d) from any county in this | |
| 14 | 14 | state by using an online format to complete the required retraining | |
| 15 | 15 | courses if: | |
| 16 | 16 | (1) the applicant is renewing certification for the | |
| 17 | 17 | first time; or | |
| 18 | 18 | (2) the applicant completed the required retraining | |
| 19 | 19 | courses in person the previous time the applicant renewed the | |
| 20 | 20 | certificate. | |
| 21 | 21 | SECTION 2. The department shall take action as necessary to | |
| 22 | 22 | ensure that an applicant may renew a qualified handgun instructor | |
| 23 | 23 | certification from any county in this state, as required by Section | |
| 24 | 24 | 411.190(d-1), Government Code, as added by this Act, not later than | |
| 25 | 25 | March 1, 2010. | |
| 26 | 26 | SECTION 3. This Act takes effect September 1, 2009. |
