44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to annual reporting of women and minority participation in
77 the management and investment of the assets of a state investment
88 fund.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 322.014(a) and (b), Government Code,
1111 are amended to read as follows:
1212 (a) In this section:[,]
1313 (1) "Minority-owned business" means a business entity
1414 at least 51 percent of which is owned by minority group members or,
1515 in the case of a corporation, at least 51 percent of the shares of
1616 which are owned by minority group members, and that is managed and,
1717 in daily operations, controlled by minority group members.
1818 (2) "Minority group members" includes:
1919 (A) African Americans;
2020 (B) American Indians;
2121 (C) Asian Americans;
2222 (D) Americans of Hispanic origin; and
2323 (E) persons with disabilities.
2424 (3) "State [state] investment fund" means any
2525 investment fund administered by or under a contract with any state
2626 governmental entity, including a fund:
2727 (A) [(1)] established by statute or by the Texas
2828 Constitution; or
2929 (B) [(2)] administered by or under a contract
3030 with:
3131 (i) [(A)] a public retirement system as
3232 defined by Section 802.001 that provides service retirement,
3333 disability retirement, or death benefits for officers or employees
3434 of the state;
3535 (ii) [(B)] an institution of higher
3636 education as defined by Section 61.003, Education Code; or
3737 (iii) [(C)] any other entity that is part
3838 of state government.
3939 (4) "Women-owned business" means a business entity at
4040 least 51 percent of which is owned by women or, in the case of a
4141 corporation, at least 51 percent of the shares of which are owned by
4242 women, and that is managed and controlled by women in its daily
4343 operations.
4444 (b) The board shall evaluate and publish an annual report on
4545 the risk-adjusted performance of and the participation by
4646 minority-owned and women-owned businesses in each state investment
4747 fund that in the opinion of the board contains a relatively large
4848 amount of assets belonging to or administered by the state. The
4949 board in its report shall:
5050 (1) compare the risk-adjusted performance of the
5151 funds; [and]
5252 (2) examine the risk-adjusted performance, within and
5353 among the funds, of similar asset classes and comparable portfolios
5454 within asset classes; and
5555 (3) detail participation by minority-owned and
5656 women-owned businesses, including the participation of
5757 minority-owned and women-owned financial services firms, expressed
5858 as a percentage of the total assets under management by outside
5959 financial services firms.
6060 SECTION 2. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect September 1, 2009.
