| 7 | 7 | | relating to a study of the effectiveness of the success initiative |

| 8 | 8 | | assessment and developmental coursework requirements and the |
|---|
| 9 | 9 | | implementation of a pilot program regarding student readiness for |
|---|
| 10 | 10 | | college-level work. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 51.3062, Education Code, is amended by |
|---|
| 13 | 13 | | adding Subsections (o-1) and (o-2) to read as follows: |
|---|
| 14 | 14 | | (o-1) As a result of its evaluation under Subsection (o), |
|---|
| 15 | 15 | | the board shall establish pilot programs, using funds appropriated |
|---|
| 16 | 16 | | to the board, at institutions of higher education to develop |
|---|
| 17 | 17 | | innovative strategies for addressing a student's deficiencies in |
|---|
| 18 | 18 | | the student's readiness to perform freshman-level academic |
|---|
| 19 | 19 | | coursework. |
|---|
| 20 | 20 | | (o-2) In connection with its evaluation under Subsection |
|---|
| 21 | 21 | | (o), the board shall perform an analysis of the effectiveness of the |
|---|
| 22 | 22 | | requirements of this section in efficiently meeting the needs of |
|---|
| 23 | 23 | | students in becoming ready to perform freshman-level academic |
|---|
| 24 | 24 | | coursework. The analysis must examine the effects of the |
|---|
| 25 | 25 | | requirements of this section on the progress and success of |
|---|
| 26 | 26 | | students who enroll in an institution of higher education. Based on |
|---|
| 27 | 27 | | the analysis, the board shall make recommendations for improving |
|---|
| 28 | 28 | | developmental coursework and assessments, including |
|---|
| 29 | 29 | | recommendations for legislation, and shall report its findings and |
|---|
| 30 | 30 | | recommendations to each institution of higher education and the |
|---|
| 31 | 31 | | legislature not later than November 1, 2010. This subsection |
|---|
| 32 | 32 | | expires January 1, 2011. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2009. |
