55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to immunity from liability of certain professional
88 employees of school districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 22.051(a), Education Code, is amended to
1111 read as follows:
1212 (a) In this subchapter, "professional employee of a school
1313 district" includes:
1414 (1) a superintendent, principal, teacher, including a
1515 substitute teacher, supervisor, social worker, counselor, nurse,
1616 and teacher's aide employed by a school district;
1717 (2) a teacher employed by a company that contracts
1818 with a school district to provide the teacher's services to the
1919 district;
2020 (3) a student in an education preparation program
2121 participating in a field experience or internship;
2222 (4) a school bus driver certified in accordance with
2323 standards and qualifications adopted by the Department of Public
2424 Safety of the State of Texas;
2525 (5) a member of the board of trustees of an independent
2626 school district;
2727 (6) a physical therapist, speech-language
2828 pathologist, audiologist, athletic trainer, or school
2929 psychologist; and
3030 (7) [(6)] any other person employed by a school
3131 district whose employment requires certification and the exercise
3232 of discretion.
3333 SECTION 2. This Act applies only to a cause of action that
3434 accrues on or after the effective date of this Act. A cause of
3535 action that accrues before the effective date of this Act is
3636 governed by the law in effect immediately before that date, and that
3737 law is continued in effect for that purpose.
3838 SECTION 3. This Act takes effect September 1, 2009.
