9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 106.03, Alcoholic Beverage Code, is | |
11 | 11 | amended by amending Subsection (c) and adding Subsection (e) to | |
12 | 12 | read as follows: | |
13 | 13 | (c) Except as provided by Subsection (e), an [An] offense | |
14 | 14 | under this section is a Class A misdemeanor. | |
15 | 15 | (e) If a person has been previously convicted of an offense | |
16 | 16 | under this section or Section 101.63, an offense under this section | |
17 | 17 | is a state jail felony. | |
18 | 18 | SECTION 2. (a) The change in law made by this Act applies | |
19 | 19 | only to an offense committed on or after the effective date of this | |
20 | 20 | Act. For purposes of this section, an offense is committed before | |
21 | 21 | the effective date of this Act if any element of the offense occurs | |
22 | 22 | before that date. | |
23 | 23 | (b) An offense committed before the effective date of this | |
24 | 24 | Act is covered by the law in effect when the offense was committed, | |
25 | 25 | and the former law is continued in effect for that purpose. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2009. |
