66 relating to compensation for certain election officers.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 32.091, Election Code, is amended to
99 read as follows:
1010 (a) An election judge or clerk is entitled to compensation
1111 for services rendered at a precinct polling place at a minimum
1212 hourly rate of $10 per hour. Except as provided by Subsection (c),
1313 an election judge or clerk is entitled to compensation for services
1414 rendered at a precinct polling place at an hourly rate not to exceed
1515 the amount fixed by the appropriate authority, which amount must be
1616 at least the federal minimum hourly wage. A judge or clerk may be
1717 compensated at that rate for services rendered under Section
1818 62.014(c).
1919 (b) A judge or clerk may not be paid for more than one hour
2020 of work before the polls open, except for payment made for work
2121 under Section 62.014(c). In a precinct in which voting machines are
2222 used, a judge or clerk may not be paid for more than two hours of
2323 work after the time for closing the polls or after the last voter
2424 has voted, whichever is later.
2525 (c) For a primary or runoff primary election or if the
2626 election officer attended a training program as provided by
2727 Subchapter F, the minimum hourly rate is $10 per hourthe minimum
2828 hourly rate is the greater of the maximum rate provided by
2929 Subsection (a) or, if the election officer attended a training
3030 program as provided by Subchapter F, [$7].
3131 (d) The Secretary of State shall reimburse the county for
3232 the difference between the federal minimum wage and the hourly rate
3333 of no less than $10 per hour.
3434 (e) Any time the federal minimum wage increases, the hourly
3535 rate paid to election workers shall increase at the same increase.
3636 SECTION 2. Section 32.114(e), Election Code, is amended to
3737 read as follows:
3838 (e) An election judge, early voting clerk, or deputy early
3939 voting clerk in charge of an early voting polling place is entitled
4040 to compensation for attending the training program at an hourly
4141 rate not to exceed the amount fixed by the appropriate authority,
4242 which amount must be at least $10 per hour[$7].
4343 (f) The Secretary of State shall reimburse the county for
4444 the difference between the federal minimum wage and the hourly rate
4545 of no less than $10 per hour.
4646 (g) Any time the federal minimum wage increases, the hourly
4747 rate paid to election workers shall increase at the same increase.
4848 SECTION 3. This Act takes effect September 1, 2009.
